CORPORATION OF THE COUNTY OF ESSEX <br />BY -LAW NUMBER 19 -2003 <br />A BY -LAW TO ESTABLISH PROCEDURES GOVERNING THE SALE OF <br />LAND <br />WHEREAS, Section 268 of the Municipal Act, 2001, S.O., 2001, c. 25 as <br />amended, requires that every municipality with authority to sell land shall pass a <br />by -law establishing procedures, including the giving of notice to the public, <br />governing the sale of land. <br />NOW THEREFORE the Council of the Corporation of the County of Essex <br />enacts as follows: <br />DEFINITIONS: <br />1. In this by -law, <br />(a) "appraisal" shall mean a written opinion as to the amount that the <br />land might be expected to realize if sold in the open market by a <br />willing seller to a willing buyer; <br />(b) "Corporation" shall mean the Corporation of the County of Essex; <br />(c) "notice" means a written, printed, published or posted notification or <br />announcement; <br />(d) "posted" means electronically publishing the notice on the County of <br />Essex web page; <br />(e) "published" means published in a daily, weekly or bi- weekly <br />newspaper that, in the opinion of the Clerk, has such circulation <br />within the local municipality where the surplus land is located, so as <br />to provide reasonable notice to the public; <br />(f) "sale" shall include a lease of 21 years or longer ; <br />(g) "web page" means the County of Essex web site at <br />www.countyofessex.on.ca <br />SURPLUS LANDS <br />2. Prior to the selling of any land, the Council of the Corporation shall, by <br />by -law or resolution, declare the land to be surplus. <br />
