BY-LAW NUMBER 2331 A BY-LAW TO AUTHORIZE THE CONSTRUCTION OF ROADS IN THE COUNTY OF ESSEX. WHEREAS, pursuant to the provisions of the Public Transportation & Highway Improvement Act, R. S. O. 1970, Chapter 201, section 45 (1) a county may, without the assent of the electors, pass by-laws to raise by debentures payable in not more than twenty years in the manner provided by The Municipal Act such sums as may be necessary to meet the actual expenditure for the construction of roads under this Part. BE IT RESOLVED THAT THE Council of the Corporation of the County of Essex enacts as follows: That a resurfacing programme be carried out in accordance with Schedule "A". That the work shall be carried on and executed under the supervision and according to directions and orders of the County Engineer. That the Warden and the Clerk are authorized to cause a contract for the construction of the work to be made and entered into with some person or persons, firm or corpora- tion, subject to the approval of this Council to be declared by resolution and subject to the approval of the Ontario Municipal Board. That the debentures to be issued for the loan to be effected to pay for the cost of the work when completed, shall bear interest at such rate as council may determine and be made payable within five years on the instalment plan. That the cost of the said work, including debenture charges and cost of maintenance and management, shall be a charge on all the rateable property in the County; and there shall be levied and raised in each year in which an instalment of principal of the said debt and interest becomes due, by a special rate on all the rateable property in the County a sum sufficient to pay the said instalment when and as it becomes due, but no greater rate shall be levied in any year for such purpose than is required to pay the instalment after taking into account receipts from any source in respect of the said work. 1st reading-Apr. 18 /79 2nd reading-Apr. 18 /79 3rd reading-Apr. 18 /79 This By-law shall come into force and take effect upon the final passing thereof.
