THIS INDENTURE made in duplicate the 1st day of January, 1971, B E T W E E N : THE CORPORATION OF THE COUNTY OF ESSEX, hereinafter called the COUNTY -and- OF THE FIRST PART: THE CORPORATION OF THE TOWN OF AMHERSTBURG THE CORPORATION OF THE TOWN OF ESSEX, THE CORPORATION OF THE TOWN OF KINGSVILLE AND THE CORPORATION OF THE TOWN OF LEAMINGTON hereinafter called respectively AMHERSTBURG ESSEX, KINGSVILLE and LEAMINGTON Y OF THE SECOND PART W H E R E A S the Council of the County has requested the Ontario Housing Corporation to provide rental housing accommodation for senior citizens resident in the County. AND WHEREAS ,a, report of the Ontario Housing Corporation dated September 1968 confirms need and effective demand for One Hundred and Sixteen (116) 1- bedroom units to be located in Amherstburg, Essex, Kingsville, and Leamington. AND WHEREAS it is deemed advisable that the Corporation of the County of Essex enter into an agreement with the said municipalities of Amherstburg, Essex, Kingsville and Leamington, whereby the Corporation of the County of Essex „Will make a „grar}t to the said municipalities in the amount equivalent to,,the 7.5% of operating losses and the local improvement costs assumed by the,,,s,ai,d Towns,,, by Agreement with the Ontario Housing Corporation, for the „rental hous,ing,units built in their respective Towns, by the Ontario Housing Corporation, within their boundaries, as approved by the County Council;,,by, resolution open Council. I' I I I NOW THIS INDENTURE WITNESSETH that in consideration of the premises the parties hereto covenant and agree as follows: 1. The County covenants and,agrees to pay from year to year the grant for the purpose as noted above to the Towns of (a) Amherstburg for 26 units, (b) Essex for 34 units, (c) Kingsville for 22 units, (d) Leamington for 34 units. 2. The said payments shall be made on the 1st day of December in each year, from the current Social & Family Services Budget of the County of Essex, upon the receipt of an account from the said municipalities. 3. In the event that any of the said units cease to be used for the purpose aforesaid the provisions of Section 1 hereof shall cease to have any force or effect for such unit. 4. This agreement shall be for a period of one (1) year and renewable ,! for periods of one (1) year on the mutual consent of the County and any of the Towns of Amherstburg,Essex,Kingsville and Leamington, by resolution,in writing, 30 days,before the termination date thereof. 1
