' 22 <br />0 <br />A BY -LAW w <br />To authorize the acquirement of certain land along the Town 1,00* <br />between Colchester and Malden, for the use of the Public Ifigh"Y' <br />and for repealing certain o her By -Laws. <br />[PeseaD 18th August, A. D., 1854. <br />I. Be it Enacted by the Municipal Council bf the County of Essex <br />in Council assembled, under and by virtue of the "Upper Canada Mu- <br />nicipal Corporations Act, of 1849," That, subject to the conditions herein- <br />After expressed, Cornelius R. Quick and Henry Wright, Eags,, membe» <br />of the said Municipal Council be Commissioners in the name and on 1* <br />half of the said Municipal Council to take a deed of conveyance in fee <br />simple of such parcel or parcels of land lying and being along the Tows <br />Line between the Townships of Colchester and Malden as may be Seca♦ <br />sary or required for completing the opening the Town Line Road between <br />the said Townships, according to the survey of Pbilo D. Salter, Esq, and <br />as directed by By -Law of this Council, numbered six, passed, dune 12th, <br />1851, and to do all things expedient or necessary for procuring the com- <br />plete opening of the said road. <br />IL That the said Commissioners are hereby authorised and empowered <br />to enter into a negotiation with the parties owning lands along the said <br />line necessary to be acquired for the purpose aforesaid for the purchase <br />thereof, and to give therefor an amount not exceeding five pounds csr- <br />rency per acre and to sign seal and deliver any agreement or contract oa <br />behalf of the said County Council which may be needful or necessary to <br />make such agreement or contract binding on behalf of the said County <br />Council. <br />III. That it shall be the duty of the said Commissioners to aupervise <br />and compel the opening of the said road and to superintend the making <br />Of the same and that all expenses in the settlement of the said line be <br />paid out of the general funds of the County upon the certificate of the <br />Commissioners, and that the said Commissioners be allowed ten shillings <br />3 PeC day each for each day so employed, and that the said Commsmoners <br />Shall be indemnified by this Council and saved harmless from any proceed- <br />ings at law that may arise to them in discharging their duties as aforesaid. <br />
