<br />The Corporation of the County of Essex <br />By-Law Number 2022-19 <br />A By-law to enter into a Cross Border Land Ambulance <br />Mutual Aid Agreement between the Corporation of the <br />County of Essex and the Municipality of Chatham-Kent for <br />cross border land ambulance services. <br />Whereas the Corporation of the County of Essex and the Municipality <br />of Chatham-Kent wish to agree, as between them, on both the criteria and <br />process for the provision of land ambulance services provided by each of <br />them for the benefit of the other, and in which circumstances payment for <br />same from the other shall be required; <br />And whereas Section 6 of the Ambulances Act, R.S.O. 1990, c. A.19, <br />as amended, authorizes the dispatching of ambulances from and within an <br />upper-tier municipality to areas outside the municipality and authorizes the <br />affected municipalities to enter into an agreement with respect to same; <br />And whereas Section 13(3) of the Emergency Management and Civil <br />Protection Act, R.S.O. 1990, c. E.9, as amended authorizes the Council of a <br />municipality to make an agreement with the Council of any other <br />municipality for the provision of personnel, service, equipment, and/or <br />material during an emergency; <br />And whereas the Corporation of the County of Essex and the <br />Municipality of Chatham-Kent have previously provided land ambulance <br />services to one another pursuant to the terms of an Agreement Under <br />Subsection 6(3) of the Ambulance Act, R.S.O. 1990, c. A.19, as amended, <br />dated July 22, 2013, as authorized pursuant to By-law No. 35-2013; <br />And whereas the respective Councils for both the Corporation of the <br />County of Essex and the Municipality of Chatham-Kent have each agreed <br />and directed that the Agreement Under Subsection 6(3) of the Ambulance <br />Act, R.S.O. 1990, c. A.19, as amended, be rescinded and a Cross Border <br />Land Ambulance Mutual Aid Agreement be entered into;
