<br />The Corporation of the County of Essex <br />By-Law Number 2021-09 <br />A By-law to accept the donation of part of Lot 36, <br />Concession 4, Malden, as in R298567, now designated as <br />Part 3 on Reference Plan 12R-28440 from George Herman <br />VandenBrink and Ruth Ann VandenBrink . <br />Whereas George Herman VandenBrink and Ruth Ann VandenBrink (the <br />"Owners") own certain property located at municipal address 4431 County <br />Road 20 in the Town of Amherstburg, legally described as Part of Lot 36, <br />Concession 4, Malden, as in R298567; Amherstburg, and bearing PIN 01539 - <br />5806 (LT) (the "Property"); <br />And whereas the Property was subject to a an application for a <br />severance before the Committee of Adjustment of the Town of Amherstburg, <br />that resulted in a Decision of Approval, dated July 28, 2020 (the <br />"Severance"); <br />And whereas the Severance has resulted in a portion of the Property <br />that abuts County Road 20 being unusable by the Owners of the Property, <br />namely the portion of the Property now known as Part 3 on Reference Plan <br />12R-28440; <br />And whereas the Owners of the Property have requested that the <br />Corporation of the County of Essex accept the piece of the Property now known <br />as Part 3 on Reference Plan 12R-28440 as a donation to form part of the public <br />highway (the "Dedication"); <br />And whereas the Corporation of the County of Essex deems it expedient <br />to accept the Dedication and assume it as part of the public highway. <br />Now therefore the Council of the Corporation of the County of Essex hereby <br />enacts as follows: <br /> <br />Page 128 of 134
