<br />The Corporation of the County of Essex <br />By-Law Number 2020-53 <br />A By-law to Authorize the Execution of a Lease Agreement <br />between The Corporation of the County of Essex, The <br />Essex-Windsor Solid Waste Authority and Christopher <br />Malott Farming Enterprises Inc. <br />Whereas the Corporation of the County of Essex (The County), on <br />behalf of the Essex-Windsor Solid Waste Authority (the Authority), is the <br />registered owner of vacant farm lands in the vicinity of the Essex-Windsor <br />Regional Landfill; <br />And Whereas The Authority, The County and Christopher Malott <br />Farming Enterprises Inc. (The Tenant) are currently parties to a lease <br />agreement dated May 3, 3016, whereby the Tenant is leasing certain vacant <br />farm land, more particularly described in the lease agreement authorized by <br />By-law 28-2016; <br />And Whereas the current lease agreement is set to expire on October <br />31, 2021, with a provision to allow three optional one year extensions, if <br />mutually agreed upon by all parties; <br />And Whereas the Authority and Tenant have agreed, one year in <br />advance of the current lease agreement expiration date, to exercise the first <br />one-year extension for the period November 1, 2021 to October 31, 2022; <br />Now therefore the Council of the Corporation of the County of Essex <br />hereby enacts as follows: <br />1) That the Warden and Clerk be and they are hereby authorized to <br />execute the Lease Extension Agreement between The County, The <br />Authority and The Tenant, a copy of which is attached hereto, and affix <br />the Corporate seal thereto. <br />2) That the term of this Lease Extension Agreement shall be for a period <br />of one year commencing on the 1st day of November, 2021 and
