<br /> <br />The Corporation of the County of Essex <br />By-Law Number 2020-41 <br />A By-law to Amend By-law Number 50-2019, Being a By-law to <br />Establish a 0.3 Metre (1 Foot Reserve) Along County Road 42. <br />Whereas By-law Number 50-2019, being a by-law to, among other <br />things, establish a 0.3 metre (1 foot) reserve along County Road 42, was <br />adopted by the Corporation of the County of Essex on November 20, 2019, <br />to limit additional access on to County Road 42 from the municipal boundary <br />between the County of Essex and the City of Windsor to Pike Creek in the <br />Town of Lakeshore. <br />And whereas the establishment of the 0.3 metre (1 foot) reserve <br />extends through the Tecumseh Hamlet in the Town of Tecumseh, which is an <br />approved Urban Settlement Area in the Official Plans of both the County of <br />Essex and the Town of Tecumseh. <br />And whereas the establishment of the 0.3 metre (1 foot) reserve in <br />an approved Urban Settlement Area is not consistent with the approved <br />policy documents of the County of Essex. <br />And whereas by way of a Motion presented to the Council of the <br />Corporation of the County of Essex on September 2, 2020 and passed by the <br />Council of the Corporation of the County of Essex on September 16, 2020, <br />directing that By-law Number 50-2019 be amended to remove the 0.3 metre <br />(1 foot) reserve within the approved Urban Settlement Area of the Town of <br />Tecumseh. <br />Now therefore the Council of the Corporation of the County of <br />Essex hereby enacts as follows: <br />1) That Sections 1 and 2 of By-law 50-2019 be amended by <br />specifically excluding the parts of Reference Plan 12R-27997, Reference Plan <br />12R-27999, Reference Plan 12R-28000, and Reference Plan 12R-28003 that <br />fall within the approved Urban Settlement Area of the Town of Tecumseh <br />from the 0.3 metre (1 foot) reserve.
