THIS AGREEMENT MADE IN TRIPLICATE THIS January , 19 86 1st DAY OF BETWEEN: THE CORPORATION OF THE COUNTY OF ESSEX HEREINAFTER CALLED THE COUNTY OF THE FIRST PART OF THE SECOND PART WHEREAS THE DAY NURSERIES ACT R.S.O. 1980, hereinafter called the "ACT" authorizes the County to enter into an agreement with any person operating a licensed day nursery for the furnishing of such day nursery services for such children as is agreed upon and for making such expenditures as are necessary for that purpose. AND WHEREAS the Operator now operates a licensed day nursery within the County of Essex. AND WHEREAS the County and the Operator have agreed that if the Operator provides day nursery services to certain children, the County will, subject to the terms and conditions of this agreement, make certain payments to the Operator. NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the mutual covenants contained herein, the parties covenant and agree as follows: 1. From the effective date of this agreement as set forth in paragraph 4, the Operator agrees to provide day nursery services in accordance with the Act as amended and the regulations thereto to any child which the Operator agrees to accept and in respect of which payment is made by the County under paragraph 2. 2. For each child in respect to which it approves for the providing of day nursery services by the Operator, the County agrees to pay the Operator as per the following schedule: (see Schedule A attached), or such other amount as may be time, between the parties hereto. 3. The Operator shall, at his expense, agreed upon from time to provide and maintain by a policy or policies and in an amount satisfactory to the County
