THE CORPORATION OF THE COUNTY OF ESSEX <br />BY-LAW # 06-2002 <br />A BY-LAW TO STOP UP AND CLOSE PART OF A <br />HIGHWAY AND TO CONVEY THE SOIL AND <br />FREEHOLD THEREOF, BEING PART OF THE <br />ROAD ALLOWANCE LOCATED SOUTHWEST OF <br />THE CEDAR CREEK BRIDGE ON COUNTY ROAD <br />50. <br />WHEREAS by Section 297(1) of the Municipal Act, R.S.O. 1990, c.M.45, as <br />amended, the Council of everymunicipality may pass by-laws for closing and <br />stopping up any highway or part of a highway and to sell the soil and freehold <br />thereof, <br />AND WHEREAS The Corporation of the County of Essex deems it expedient to stop <br />up and close a certain portion of the road allowance on Registered Plan 896 in the <br />Town of Kingsville, former Township of Gosfield South, being Part 4 of Plan 12R- <br />19328, pursuant to Section 315 of the Municipal Act, R.S.O. 1990, c.M.45, as <br />amended; <br />AND WHEREAS, the provisions of Section 297 and 300 of the Municipal Act, <br />R.S.O. 1990, c.M.45, as amended, have been complied with: <br />NOW THEREFORE the Council of the Corporation -of the County of Essex enacts as <br />follows: <br />1. THAT the portion of highway described in Schedule "A" attached hereto <br />and forming part of this by-law is hereby stopped up and closed. <br />2. THAT the soil and freehold of such stopped up and closed portion of <br />highway be transferred to the owner of abutting lands as described in <br />Schedule `B" attached and forming part of this by-law in consideration of <br />$1.00 and all of the expenses incurred for closing the highway and <br />transferring the land be the responsibility of the County. <br />3. THAT the Clerk be directed to take all necessary steps to complete the <br />transaction and the Warden and Clerk be authorized to execute any <br />documents in connection therewith. <br />4. This By-law shall come into force and take effect on the 20th day of <br />February, 2002. <br />
