THE CORPORATION OF THE COUNTY OF ESSEX <br />BY -LAW NUMBER 50 -209.1 <br />BEING A BY -LAW TO AUTHORIZE A SINGLE <br />RESIDENTIAL TAX RATE FOR COUNTY <br />PURPOSES FOR THE MUNICIPAL CAPITAL <br />FACILITY FOR AFFORDABLE HOUSING <br />LOCATED ON THE NORTH SIDE OF PROSPECT <br />STREET IN THE TOWN OF KINGSVILLE AND <br />REPEAL BY -LAW 03 -2011 <br />WHEREAS Section 110(6) of the Municipal Act 2001, provides that <br />the council of a municipality may pass by -laws exempting property, or a <br />portion of it, from taxation for municipal and school purposes on which <br />municipal capital facilities are located; and <br />AND WHEREAS paragraph 18 of section 2 of Ontario Regulation <br />46/94, as amended, prescribes municipal facilities for municipal housing <br />project facilities as eligible municipal capital facilities; <br />AND WHEREAS at its meeting of December 13, 2010, the Council <br />of the Town of Kingsville enacted By -law 182 -2010 authorizing a single <br />residential tax rate for lower tier municipal purposes for the municipal <br />capital facility for affordable housing located at the corner of Prospect <br />and Lansdowne in the Town of Kingsville, legally described as Part of Lot <br />1, Concession 1 ED in the former Township of Gosfield South, more <br />particularly described as 12R -23675 Parts 1 and 2 (Roll #37- 11 -170- <br />000- 091 -50 -0000) (the "Premises ") be assessed at a single residential <br />tax rate for municipal purposes effective from the date that the first unit <br />of affordable housing on the Premises is occupied by a tenant selected in <br />accordance with the Canada- Ontario Housing Program. <br />AND WHEREAS at its meeting of January 19th, 2011, Essex County <br />Council enacted By -law 03 -2011 authorizing a single residential tax rate <br />for county purposes for the Premises be assessed at a single residential <br />tax rate for municipal purposes effective from the date that the first unit <br />of affordable housing on the Premises is occupied by a tenant selected in <br />accordance with the Canada - Ontario Housing Program. <br />AND WHEREAS the Housing Provider has disposed of a portion of <br />the Premises, being Parts 1, 2 and 3 on Plan 12R- 24781, and is the <br />owner of the remaining lands located on the north side of Prospect Street <br />in the Town of Kingsville, legally described as Part of Lot 1, Concession 1 <br />ED in the former Township of Gosfield South, more particularly described <br />as Parts 1 and 2 on 12R23675, save and except for Parts 1, 2 and 3 on <br />Plan 12R -24781 (the "Subject Premises "). <br />
