The Corporation of the County Of Essex By -Law No, 79 -2012 A By -law Authorizing the Execution of an Amendment to the Infrastructure Stimulus Fund Contribution Agreement Whereas an Infrastructure Stimulus Fund Contribution Agreement, dated October 26th, 2009 (First ISF Agreement), was executed by the Corporation of the County of Essex (hereafter referred to as "the County ") and Her Majesty the Queen in Right of Ontario And whereas Her Majesty the Queen in Right of Ontario, for the purposes of this amending Agreement, is now represented by the Minister of Infrastructure and the Minister of Agriculture, Food and Rural Affairs, (hereafter referred to as "Ontario" and " OMAFRA" respectively); And whereas the said Agreement has expired; And whereas the County and Ontario have determined that it is in their mutual interests to restore the Agreement to facilitate the payment of Funds for the Leamington EMS Base Project that have not already been paid to the County under the First ISF Agreement; Now therefore the Council of the Corporation of the County of Essex hereby enacts as follows: 1. That the First ISF Agreement be restored to a limited degree, but for its expiration date as provided for below, and only to the extent that the reports and supporting documents have not already been delivered to OMAFRA and the Funds have not already been paid by OMAFRA to the County. The definitions, terms and conditions including the Project description, of the First ISF Agreement apply to this Agreement mutatis mutandis. 2. That the expiration date of this agreement means March 31, 2013. 3. That the Warden and Clerk be and they are hereby authorized to execute the Amending Agreement between Ontario and the County, a copy of which is attached hereto. 4. This By -law shall come into force and take effect after the final passing.
