THE CORPORATION OF THE COUNTY OF ESSEX <br />BY -LAW #27 -2005 <br />A BY -LAW TO ESTABLISH THE RETENTION PERIODS <br />FOR VARIOUS DOCUMENTS AND RECORDS OF THE <br />CORPORATION OF THE COUNTY OF ESSEX <br />WHEREAS section 255 of the Municipal Act,, 2001, S.( ). 20()1 c.25, as amended, <br />provides that a municipality may, subject to the approval of the municipal auditor, <br />establish retention periods during which records of the municipality must be retained and <br />preserved; <br />AND WHEREAS the Municipal Council of the Corporation of the County of <br />Essex wishes to provide for the orderly retention and subsequent destruction or other <br />disposition of records of the municipality; <br />THEREFORE the Council of the Corporation of the County of Essex enacts as <br />follows: <br />1. That records are defined as documentary materials regardless of physical <br />format that are created and received in connection with the transaction of the <br />Corporation of the County of Essex business and /or contain information on <br />the organization, functions, procedures, policies or activities of the <br />Corporation; <br />2. That records are the property of the Corporation of the County of Essex; <br />3. That retention periods for the records of the Corporation of the County of <br />Essex are set out in Schedule "A ", attached hereto and forming part of this <br />By -law, as amended from time to time; <br />4. That records having reached the expiry of the retention period, as set out in <br />Schedule `A', shall be destroyed of in accordance with the Records <br />Destruction Policy of the Corporation of the County of Essex, as amended <br />from time to time. <br />5. That By -law #2198 be and is hereby repealed in its entirety. <br />6. This By -law shall come into force and tape effect upon receiving approval of <br />the firm of KPMG LLP, Chartered Accountants, appointed Municipal <br />Auditors for the Corporation of the County of Essex by virtue of By -law <br />Number 64 -2004, dated December 15`x', 2004. <br />
