THE CORPORATION OF THE COUNTY OF ESSEX BY -LAW #27 -2005 A BY -LAW TO ESTABLISH THE RETENTION PERIODS FOR VARIOUS DOCUMENTS AND RECORDS OF THE CORPORATION OF THE COUNTY OF ESSEX WHEREAS section 255 of the Municipal Act,, 2001, S.( ). 20()1 c.25, as amended, provides that a municipality may, subject to the approval of the municipal auditor, establish retention periods during which records of the municipality must be retained and preserved; AND WHEREAS the Municipal Council of the Corporation of the County of Essex wishes to provide for the orderly retention and subsequent destruction or other disposition of records of the municipality; THEREFORE the Council of the Corporation of the County of Essex enacts as follows: 1. That records are defined as documentary materials regardless of physical format that are created and received in connection with the transaction of the Corporation of the County of Essex business and /or contain information on the organization, functions, procedures, policies or activities of the Corporation; 2. That records are the property of the Corporation of the County of Essex; 3. That retention periods for the records of the Corporation of the County of Essex are set out in Schedule "A ", attached hereto and forming part of this By -law, as amended from time to time; 4. That records having reached the expiry of the retention period, as set out in Schedule `A', shall be destroyed of in accordance with the Records Destruction Policy of the Corporation of the County of Essex, as amended from time to time. 5. That By -law #2198 be and is hereby repealed in its entirety. 6. This By -law shall come into force and tape effect upon receiving approval of the firm of KPMG LLP, Chartered Accountants, appointed Municipal Auditors for the Corporation of the County of Essex by virtue of By -law Number 64 -2004, dated December 15`x', 2004.
