<br />- 2- <br /> <br />a) Part of Lot 281, Concession North Talbot Road, in the Town of <br />Kingsville (formerly the Township of Gosfield North), in the County <br />of Essex designated as Part 1 on Reference Plan 12R-24148 and <br />now designated as Part 1 on the draft Expropriation Plan No. H- <br />i 036 "A"; and <br /> <br />b) Part of Lot 281, Concession North Talbot Road, in the Town of <br />Kingsville (formerly the Township of Gosfield North), in the County <br />of Essex designated as Part 2 on Reference Plan 12R-24148 and <br />now designated as Part 2 on the draft Expropriation Plan No. H- <br />i 036 "A"; and <br /> <br />c) Part of Lots 281 and 282, part of the road allowance between <br />Concession 5 and Concession North Talbot Road, and part of the <br />original road allowance between Lots 281 and 282, all in <br />Concession North Talbot Road, in the Town of Lakeshore <br />(formerly the Township of Maidstone), in the County of Essex <br />designated as Part 3 on Reference Plan 12R-24148 and now <br />designated as Part 3 on the draft Expropriation Plan No. H-1036 <br /> <br />nAu. <br /> <br />2. THAT the Warden and the Clerk be and the same are hereby <br />authorized to execute the Certificate of Approval and the <br />Expropriation Certificate set out on the draft Expropriation Plan, a <br />copy of which is attached as Schedule "A" to this By-law, and to <br />execute any and all other documentation required to expropriate <br />the lands referred to in Section 1 herein and to proceed with the <br />expropriation process. <br /> <br />3. THAT the Clerk and the solicitor of the Corporation are hereby <br />authorized to cause the draft Expropriation Plan to be registered in <br />the Land Registry Office for the County of Essex and thereby effect <br />the expropriation of the said lands. <br /> <br />4. THAT the Corporation is hereby authorized to enter onto and take <br />possession of the expropriated lands on the date permitted under <br />the Expropriations Act, as amended or pursuant to any Court Order <br />thereunder, or pursuant to any agreement entered into between the <br />relevant property owner(s) and the Corporation. <br /> <br />5. THAT the Clerk and the solicitor for the Corporation are hereby <br />authorized to deliver all of the required Notices, offers, appraisal <br />reports and other documents, and to do all other things and to give <br />all other Notices in accordance with the provisions of Expropriations <br />Act, as amended. <br />
