<br />THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br />BY-LAW NUMBER 71-2009 <br /> <br />A BY-LAW TO GRANT APPROVAL TO <br />AN APPLICATION FOR APPROVAL TO <br />EXPROPRIATE CERTAIN LANDS IN <br />THE TOWN OF KINGSVILLE ALONG <br />PORTIONS OF COUNTY ROAD 31 AND <br />ROAD 3 EAST, AND IN THE <br />MUNICIPALITY OF LEAMINGTON <br />ALONG PORTIONS OF COUNTY ROAD <br />31 AND THE ROAD ALLOWANCE <br />BETWEEN CONCESSIONS 2 AND 3, <br />LOCALLY KNOWN AS WILKINSON <br />DRIVE, AND TO AUTHORIZE THE <br />PURCHASE OF CERTAIN LANDS. <br /> <br />WHEREAS the Corporation is in a position to begin the <br />reconstruction of the intersection of County Road 31 with Road 3 East <br />in the Town of Kingsville and Wilkinson Drive in the Municipality of <br />Leamington as approved under the Environmental Study Report <br />prepared by Stantec Consultants Ltd. dated April, 2009 produced <br />under the Environmental Assessment Act; <br /> <br />AND WHEREAS the Corporation made an Application for <br />Approval dated November 12, 2009 to expropriate certain lands in part <br />of Lot 13, Concession 3, Eastern Division, in the Town of Kingsville <br />(formerly the Township Gosfietd South) and part of Lot 1, Concession <br />3 in the Municipality of Leamington (formerly the Township of Mersea), <br />in the County of Essex, which lands are designated as Parts 2, 3, 4 <br />and 5 on Reference Plan 12R- 24146; <br /> <br />AND WHEREAS to date the Corporation has not been <br />successful in negotiating a purchase of any of these lands on terms <br />and conditions satisfactory to the Corporation; <br /> <br />AND WHEREAS no property owner has requested the Attorney <br />General to appoint an Inquiry Officer to hold a Hearing of Necessity <br />under the Expropriations Act, R.S.O. 1990, Chapter E. 26 as amended <br />for any of the affected lands; <br /> <br />II <br />
