THE CORPORATION OF THE COUNTY OF ESSEX BY-LAW NUMBER 21-2009 BEING A BY -LAW TO CONFIRM THE PROCEEDINGS OF THE COUNCIL OF THE CORPORATION OF THE COUNTY OF ESSEX WHEREAS under Section 5(1) of the Municipal Act, 2001, S.D. 2001, c.25 as amended, the powers of a municipality shall be exercised by its Council; and WHEREAS wlder Section 5(3) ofthe Municipal Act, 2001, S.D. 2001, c.25 as amended, a municipal power, including a municipality's capacity, rights, powers and privileges under Section 8 of the Municipal Act, 2001, S.D. 2001, c.25 as amended, shall be exercised by by-law unless the mWlicipality is specifically authorized to do otherwise; and; WHEREAS it is deemed expedient that the proceedings of the Council of The Corporation of Essex at this Session be confirmed and adopted by by-law. NOW THEREFORE the Council of The Corporation of the County of Essex enacts as follows: 1. THAT the actions of the Council of The Corporation of the County of Essex in respect of all recommendations in reports of committees, all motions and resolutions and all other action passed and taken by the Cowlcil of The Corporation of the County of Essex, documents and transactions entered into during the March 18th, 2009, Regular Session of Council, are hereby adopted and confirmed, as if the same were expressly embodied in this By-law. 2. THAT the Warden and proper officials of The Corporation of the County of Essex are hereby authorized and directed to do all the things necessary to give effect to the action of the Council of The Corporation of the County of Essex during the said March 18t\ 2009, Regular Session referred to in Section 1 of this By-law. 3 . THAT the Warden and the Clerk are hereby authorized and directed to execute all documents necessary to the action taken by this Council as described in Section 1 of this By-law and to affix the Corporate Seal of The Corporation of the County of Essex to all documents referred to in said Section 1.
