THE CORPORATION OF THE COUNTY OF ESSEX BY-LAW NUMBER 05 - 2009 A BY-LAW AUTHORIZING THE ALLOCATION OF FUNDS TO THE CORPORATION OF THE TOWN OF ESSEX IN ACCORDANCE WITH SECTION 6 OF THE AGREEMENT WITH THE ASSOCIATION OF MUNICIPALITIES OF ONTARIO FOR THE TRANSFER OF FEDERAL GAS TAX REVENUES UNDER THE NEW DEAL FOR CITIES AND COMMUNITIES MADE AS OF DECEMBER 21, 2005 C.apitalized terms used in this By-law and not defined belo,v shall have tile meanings ascribed to them in tile Municipal Funding Agreement. WHEREAS TIle Corporatiol1 of the COllnty of Essex (tIle "Upper-tier Municipality") Ilas elltered into tIle agreell1ellt Wit11 TIle Association of Mllnicipalities of Ontario ("AMO") for tIle traIlsfer of federal gas tax revenlles tInder tIle l1ew deal for cities and comnlunities lllade as of Decenlber 21,2005 (tIle "Municipal Funding A~reemen t"); AND WHEREAS Sectioll 6.1 oftlle Mlmicipal FUl1ding Agreelnellt provides tllat AMO will allocate tIle FlU1ds to Recipients 011 a per capita basis witll allocations nlade 011 a 50:50 basis to Upper Tier MUl1icipalities and Lower Tier Ml111icipalities, wl1ere tIley exist; AND WHEREAS Section 6.2 of tIle MUllicipal Fllnding Agreenlent furtller provides that wllere a Recipient decides to allocate Flmds to al10tIler Eligible Recipiel1t it 111l1st be dOlle by by-law. TIle by-law mllst be passed and sllbnlitted mmually to AMO on or before MarcIl 3151. TIle by-law will identify the Eligible Recipient and tIle 811101111t of Funds the Eligible Recipient is receivillg for tllat MUllicipal Fiscal Year; AND WHEREAS Sub~ectiol1 6.2.a. of the Municipal FUllding Agreement furtller provides tllat ill tIle case of a Recipient transferring Flmds tIle Recipient is still required to sublnit an Amlllal Expenditllre Report as per Sllbsections 7.1.a., c. alld f. of tIle MllllicipaI Funding Agreelnellt. TIle Eligible Recipiellt is responsible for all otIler provisions of SectiollS 7.1 and 7.2 of tIle Municipal Flmding Agreement; AND WHEREAS tIle Upper-tier MU1llcipality constitlltes a Recipient under the Municipal Funding Agreenlellt aIld tIle Upper-tier Municipality Ilas indicated that it is willing to allocate 7.25% of tIle Fllnds transferred by AMO to tIle Upper-tier Municipality, to TIle Corporatiol1 of the Town of Essex (the "Eligible Recipient") ill aCCOrdaI1Ce witIl Section 6.2 of tIle Municipal Fundillg Agreement, nlore specifically on the basis set Ollt in Sclledllle "A" attacl1ed llereto aIld fOfIning part of tllis By-law ("Schedule "A"");
