THE CORPORATION OF THE COUNTY OF ESSEX <br />BY -LAW NUMBER 60 -2008 <br />A BY -LAW TO AUTHORIZE THE EXECUTION OF A LEASE <br />AGREEMENT BETWEEN THE CORPORATION OF THE <br />COUNTY OF ESSEX, ESSEX - WINDSOR SOLID WASTE <br />AUTHORITY AND UNION WATER SUPPLY SYSTEM. <br />WHEREAS The Corporation of the County of Essex is the owner of the closed <br />Essex County Landfill Site No. 2 lands; <br />AND WHEREAS the Essex - Windsor Solid Waste Authority has been assigned <br />responsibility by the County of Essex and the City of Windsor for the perpetual <br />care of the closed Essex County Landfill Site No. 2 pursuant to an agreement <br />dated the 1 S day of May, 1994; <br />AND WHEREAS Union Water Supply System, by its Joint Board of <br />Management pursuant to TRANSFER ORDER Union W1/1999 made under the <br />Municipal Water and Sewage Transfer Act, 1997, has authority to enter into <br />agreements for the purpose of constructing, operating, repairing and improving <br />the water supply for the Municipality of Leamington, Town of Kingsville, Town <br />of Essex and Town of Lakeshore; <br />AND WHEREAS Union Water Supply System wishes to construct and operate a <br />water tower on the closed Essex County Landfill Site No. 2 lands as a necessary <br />improvement to the water supply system; <br />AND WHEREAS the Essex - Windsor Solid Waste Authority and the Corporation <br />of the County of Essex have consented to the construction and ongoing operation <br />and maintenance of the water tower subject to the terms and conditions contained <br />in the Agreement attached hereto; <br />NOW THEREFORE the Council of the Corporation of the County of Essex <br />enacts as follows: <br />THAT the Warden and Clerk be and they are hereby authorized to <br />execute a Lease Agreement with the Essex - Windsor Solid Waste <br />Authority and Union Water Supply System, attached hereto and <br />affix the Corporate Seal thereto. <br />2.
