THE CORPORATION OF THE COUNTY OF ESSEX BY -LAW NUMBER 03 -2007 A BY -LAW TO AUTHORIZE THE CONTINUATION OF THE EXPENSE ALLOWANCE TAX BENEFIT TO MEMBERS OF ESSEX COUNTY COUNCIL AND ITS LOCAL BOARDS WHEREAS subsection 255(1) of the Municipal Act, R.S. O. 1990, c. M45, as amended, provided that one -third of the remuneration paid to elected members of councils and their local boards shall be considered as expenses incident to the discharge of their duties as members of council or local board; AND WHEREAS subsection 255(2) of the Municipal Act, R.S. O. 1990, c. M. 45, as amended provided that the provisions of subsection 255(1) shall only continue to apply to members of council or its local boards after January 1, 2003 if the municipality passed a resolution or by -law before January 1, 2003 stating its intention that the provisions of subsection 255(1) shall continue to apply to elected members of council and its local boards; AND WHEREAS the Council of the Corporation of the County of Essex, on the 21 day of August, 2002 adopted Resolution # 223/02 authorizing the provisions of subsection 255(1) to continue to apply to the elected members of Essex County Council and its local boards on and after January 1, 2003; AND WHEREAS Section 283(7) of the Municipal Act, 2001, S.O.2001, c.25 as amended, requires that on or after December 1, 2003, Council shall review the by- law authorizing the continuation of the one -third expense allowance, at a public meeting, at least once during each four -year period corresponding to the term of office of its members after a regular election.; NOW THEREFORE the Council of the Corporation of the County of Essex enacts as follows: L THAT Essex County Council reaffirm Resolution # 223/02, dated August 21 2002, authorizing the provisions of subsection 255(1) of the Municipal Act, R. S. O. 1990, c. M. 45, as amended, to continue to apply to elected members of Essex County Council and its local boards. 2. THAT this by -law shall come into force and take effect on the date of passing.
