THE CORPORATION OF THE COUNTY OF ESSEX BY -LAW NUMBER 68-2006 A BY-LAW AUTHORIZING THE EXECUTION OF AMENDMENT TO AN AGREEMENT, ENACTED BY VIRTUE OF BY-LAW 3129-94, BETWEEN THE CORPORATION OF THE COUNTY OF ESSEX AND THE CORPORATION OF THE CITY OF WINDSOR FOR THE PURPOSES OF CREATING AND OPERATING THE ESSEX-WINDSOR SOLID WASTE AUmORITY WHEREAS an Agreement was entered into between the Corporation of the County of Essex, ("the County") and the Corporation of the City of Windsor, ("the City") for the purposes of creating and operating the Essex-Windsor Solid Waste Authority ("the Authority"), which Agreement is dated the 181h day of May, 1994; AND WHEREAS Section 5(q)(i) of the said Agreement states that until otherwise determined by the parties hereto, waste collection and recycling collection within the City of Windsor, as well as operations at the City of Windsor Waste Transfer Station, will remain the responsibility of the City; AND WHEREAS Canada Section 5(q)(iii) of the said Agreement states that despite the provisions of paragraph 5(q)(i), the Authority may enter into an agreement with the City or County respecting the purchase of a waste management service, subject to the terms and conditions as may be agreed upon; NOW THEREFORE the Council of the Corporation of the County of Essex enacts as follows: I. TRA T the Warden and Clerk be and they are hereby authorized to execute an amendment to the said Agreement, enacted by virtue of By-law Number 3129-94, dated the 18th day of May, 1994, between the County and the City, a copy of which is attached hereto, and affix the Corporate Seal thereto. 2.
