<br />THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br />BY -LAW NUMBER 64-2006 <br /> <br />A BY-LAW TO AUTHORIZE THE EXECUTION OF AN ELECTRICITY <br />APPOINTMENT AND RETAINER AGREEMENT BETWEEN THE <br />CORPORATION OF THE COUNTY OF ESSEX AND LOCAL <br />AUTHORITY SERVICES LTD. (LAS) <br /> <br />WHEREAS, by virtue of By-law # 63-2006 enacted the 20th day of September, <br />2006, the Council of the Corporation of the County of Essex ("Corporation") adopted <br />Commodity Price Hedging Policy #06-001, in accordance with Section 6(1) of Ontario <br />Regulation 653/05 of the Municipal Act, 2001; <br /> <br />AND WHEREAS the Corporation deems it expedient to enter into an Agency <br />Appointment and Retainer Agreement ("Agreement") with Local Authority Services Ltd. <br />("LAS"), a wholly owned subsidiary company of the Association of Municipalities of <br />Ontario, as Agent, to negotiate all required electricity purchases on behalf of all <br />procurement program members; <br /> <br />NOW THEREFORE the Council of the Corporation of the County of Essex enacts <br />as follows: <br /> <br />1. THAT the Director of Corporate Services/Treasurer be and he is hereby <br />authorized to execute the Agreement between the Corporation and LAS, <br />and all other related documents, attached hereto and forming part of this <br />by-law and fix the Corporate Seal thereto. <br /> <br />2. That the Corporation authorize LSA, through its appointed agent, to have <br />access to consumption data from the local electricity utility on an as <br />needed basis, in order to compile load profile information for the <br />procurement program. <br /> <br />3. That the Corporation delegate authority to the Director of Corporate <br />Services / Treasurer to make electricity procurement program-related <br />decisions for the Corporation of the County of Essex. <br /> <br />4. This by-law shall come into force and take effect on the 20th day of <br />September 2006. <br /> <br />II <br />
