<br />THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br />BY-LAW NUMBER 52-2006 <br /> <br />BEING A BY-LAW TO PROVIDE FOR THE LIMITATION OF <br />TAX DECREASES FOR 2006 IN THEMUL TI-RESIDENTIAL, <br />COMMERCIAL AND INDUSTRIAL PROPERTY CLASSES <br /> <br />WHEREAS Part IX of the Municipal Act, 2001, S.D. 2001, c.25 as amended, establislles <br />limitation on taxes for certail1 property classes; <br /> <br />AND WHER.EAS Section 330 of tIle MunicipalAct, 2001, S.D. 2001, c.25 as atnended, <br />provides tIlat tIle Council of an upper-tier lTIunicipality rnaypass a by-law to establisll <br />percentages by Wllicll tax decreases are limited for 2006 in respect of prop'erties in th.e <br />multi-residential, commercial and industrial propelty classes in order to recover revenues <br />foregone as a result of tIle limitation of taxes to other properties in tlIose property classes; <br /> <br />NOW THEREFORE, th.e Council of the Corporation of the County of Essex 11ereby <br />enacts as follows: <br /> <br />1. THAT the cut-.off date for adjustnlents to the 2006 Pre-Flip File <br />was April 130\ 2006. <br /> <br />2. THAT' the percentages for 2006 under Section 330 of tIle <br />Municipal Act, 20a]J S.D. 20.01, c.25 as atnended, for the County <br />of Essex sllallbe as indicated in th.e attaclled Schedule 'A'. <br /> <br />3 . THAT the Treasurer of eaclllower-tier lTI.unicipality in the County <br />of Essex sllall be advised by the upper-tier of tIle said date <br />establisl1ed in Section 1 and the 2006 tax decrease pllase-in <br />percentages by class establislled in Section 2. <br /> <br />4.THA T the County of Essex sIlall provide adjustm.ents between <br />municipalities, in tJle amounts establislled on Sclledule 'B', so that <br />no lower-tier municipality has a surplus or shortfall as a result of <br />tIle application of this by-law . <br /> <br />5. THAT if tIle Cou.nty of Essex experiences a shortfall as a result of <br />tIle application of Section 4, tIle sllortfall shall be shared by tIle <br />County of Essex and tIle lower-tier lTIUIlicipalities in the saIne <br />proportion as tIle municipalities share in tIle taxes levied on the <br />property class for m.unicipalpurp'oses. <br />
