<br />AND WHEREAS pursuant to the Municipal Funding Agreement, taking into <br />account the provisions of Sections 6 and 7 thereof, the Recipient is subject to various <br />responsibilities and obligations in respect of all the Eligible Projects and the Funds <br />notwithstanding that after the allocation the Recipient will transfer to the Eligible <br />Recipient, from the Funds that the Recipient receives from AMO, the Allocated Funds, <br />and the Eligible Recipient will expend the Allocated Funds on Eligible Projects that are <br />the responsibility of the Eligible Recipient and in respect of which the Recipient has no <br />responsibility. <br /> <br />AND WHEREAS the Recipient and the Eligible Recipient deem it desirable for <br />the Eligible Recipient to agree to assume the responsibilities and obligations of the <br />Recipient under the Municipal Funding Agreement as they relate to the Allocated Funds <br />and the Eligible Projects in respect of which such Allocated Funds will be expended. <br /> <br />AND WHEREAS it is deemed to be expedient for the Upper-tier Municipality to <br />execute the Allocation of Funds Agreement. <br /> <br />NOW THEREFORE the Council of The Corporation of the County of Essex <br />enacts as follows: <br /> <br />1. <br /> <br />THAT the Warden and the Clerk be and they are hereby authorized to <br />execute the Allocation of Funds Agreement and affix the Municipal Seal <br />thereto. <br /> <br />2. <br /> <br />~By-law shall come into fO;;;Zuf February, <br /> <br /> <br />NELSON SANTOS, DEPUTY WARDEN <br /> <br />fJ1cc~ ~4'.4L' <br />MARY S.
