CORPORA TION OF THE COUNTY OF ESSEX BY -LA W NUMBER 36-2005 A BY-LAW TO AUTHORIZE THE OFFERING FOR SALE OF PART OF LOT 16, CONCESSION 8, IN THE TOWN OF ESSEX, (FORMERLY THE TOWNSHIP OF COLCHESTER NORTH) WHEREAS the Corporation of the County of Essex did, on behalf of the Essex- Windsor Solid Waste Authority, purchase certain lands in part of Lot 16, Concession 8, in the Town of Essex (formerly the Township of Colchester North) in accordance with the terms and conditions of the Residents Compensation Policy in effect for the Regional Landfill; AND WHEREAS, in light of the fact that the Essex-Windsor Solid Waste Authority has determined that these lands are surplus to the needs of the Authority, the Corporation has determined that these lands are surplus to the needs of the County of Essex; NOW THEREFORE the Council of the Corporation of the County of Essex enacts as follows: 1. The lands located in part of Lot 16, Concession 8, in the Town of Essex (formerly the Township of Colchester North), in the County of Essex, now designated as Part 1 on Reference Plan 12R-22085 shall be offered for sale to any person who may be interested in purchasing these lands. Upon receipt of an Offer to Purchase on terms and conditions satisfactory to the Corporation, these lands may then be sold in accordance with the terms of that Offer to Purchase. 2. In offering the said lands to any interested person, the Corporation shall be guided by the appraisals of the fair market value of these lands prepared by Derochie & Associates Ltd,. dated August 3rd, 2004 and Sovereign Appraisals, dated August 4th, 2004. 3. The lands designated as part of Lot 16, Concession 8, in the Town of Essex (formerly the Township of Colchester North) in the County of Essex are hereby declared to be surplus to the needs of the Corporation of the County of Essex.
