<br />THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br />BY-LA W NUMBER 18-2005 <br /> <br />A BY -LA W TO AUTHORIZE THE SIGNING OF AN <br />AMENDING AGREEMENT BETWEEN THE <br />CORPORA TION OF THE COUNTY OF ESSEX AND <br />THE CORPORATION OF THE CITY OF WINDSOR <br />PERTAINING TO THE ESTABLISHMENT OF THE <br />ESSEX- WINDSOR SOLID WASTE AUTHORITY <br /> <br />WHEREAS The Corporation of the County of Essex, under the authority of By-law <br />Number 3129, dated May 18th, 1994, entered into an Agreement with the Corporation of <br />the City of Windsor pertaining to the establishment ofthe Essex-Windsor Solid Waste <br />Authority; <br /> <br />AND WHEREAS Clause 4.(b)(iii) of the said Agreement stipulates the membership of <br />the Authority to include, "The Mayor and Warden, ex officio"; <br /> <br />AND WHEREAS Clause 23 of the said Agreement provides that, "Subject to any <br />provisions of this Agreement to the contrary, any of the terms of this Agreement may be <br />amended with the consent of the parties hereto and any and all amendments shall be in <br />writing and shall be binding on all of the parties to this Agreement". <br /> <br />AND WHEREAS The Board of Directors of the Essex-Windsor Solid Waste Authority, <br />at their meeting of April 5, 2005, passed a resolution requesting the Council of the <br />County of Essex and the Council of the City of Windsor to amend Clause 4.(b)(iii) to <br />allow the Mayor and Warden to designate a replacement from their respective Councils <br />to serve in their seat on the Authority; <br /> <br />NOW THEREFORE the Council of the Corporation of the County of Essex enacts as <br />follows: <br /> <br />1. THAT Clause 4.(b)(iii) of the Agreement between the Corporation of <br />the County of Essex and the Corporation of the City of Windsor, dated <br />May 18th, 1994, pertaining to the establishment of the Essex-Windsor <br />Solid Waste Authority be amended as follows: <br /> <br />(iii) The Mayor and Warden, or their designate; <br /> <br />2. This By-law shall come into force and take effect on the 2cYh day of April 2005. <br />
