<br />THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br />BY -LA W # 02-2005 <br /> <br />A BY-LAW TO AMEND BY-LAW # 01-99, BEING A BY-LAW <br />TO PROVIDE RULES GOVERNING THE ORDER AND <br />PROCEEDINGS OF THE COUNCIL OF THE <br />CORPORA TION OF THE COUNTY OF ESSEX <br /> <br />WHEREAS the Council of the Corporation of the County of Essex has adopted a <br />By-law which sets out Rules of Order and Proceedings for Council; <br /> <br />AND WHEREAS it is necessary from time to time to amend such Rules of Order <br />and Proceedings to reflect the wishes of the Council of the day; <br /> <br />NOW THEREFORE BE IT RESOLVED that By-law # 01-99 is hereby amended <br />as follows: <br /> <br />1) The wording of Section 32 (3) is hereby deleted and the following wording <br />substituted: <br /> <br />The Clerk shall record the attendance of Councillors at the Council Session for <br />the minutes. <br /> <br />2) Sections 68 to 72 regarding purchasing procedures are hereby revoked. <br />Purchasing policies and procedures for the Corporation of the County of Essex are <br />set out in Policy 04-002 and enacted by By-law #63-2004, dated December 15, <br />2004. <br /> <br />3) Sections 73 to 78 regarding procedures for the disposal of surplus assets are <br />hereby revoked. Policies and procedures for disposing of surplus assets of the <br />Corporation of the County of Essex are set out in Section 8.0 of Policy 04-002 <br />and enacted by By-law #63-2004, dated December 15, 2004. <br /> <br />4) The wording of Section 107 is hereby deleted and the following substituted: <br /> <br />Per diems shall not be deducted from Councillors annual salaries for absences <br />from regular Council Sessions. Councillors are requested, if possible, to advise <br />the Director of Council Services/Clerk if they will be absent from regular Council <br />Sessions or Standing Committee meetings prior to the meetings. Instances of <br />frequent absences of a Councillor will be addressed by the County Warden as <br />he/she deems fit. <br /> <br />5) This by-law shall come into force and take effect on the 19th, day of January 2005. <br />
