THE CORPORATION OF THE COUNTY OF ESSEX <br />BY -LAW NUMBER 59 -2004 <br />A BY -LAW PROHIBITING THE OPERATION <br />OF HEAVY TRAFFIC ON A HIGHWAY <br />WHEREAS, the Highway Traffic Act, R.S.O. 1990, c. H.8, authorizes that a <br />municipality having jurisdiction over a highway may by by -law, prohibit the operation of <br />a vehicle on a highway having a gross vehicle weight or registered gross vehicle weight <br />of four thousand five hundred kilograms (4500 kg) or more. <br />AND WHEREAS, it is expedient to prohibit the operation of heavy traffic on a <br />highway in the Towns of Tecumseh and Lakeshore: <br />NOW THEREFORE, the Council of the Corporation of the County of Essex enacts <br />as follows: <br />1. Definitions: <br />(a) "gross vehicle weight" means the total weight in kilograms <br />transmitted to the highway by a vehicle, or combination of <br />vehicles, and load; <br />(b) "heavy traffic" means any vehicle having a gross vehicle weight of <br />four thousand five hundred kilograms (4500 kg) or more. <br />2. No vehicle with a gross vehicle weight or registered gross vehicle weight <br />in excess of 4500 kg shall be operated on County Road 19 (Manning <br />Road) from Highway No. 401 to County Road 42 in the Town of <br />Tecumseh and Town of Lakeshore (former Township of Maidstone). <br />3. The provisions under Section 1 above shall not apply to authorized <br />emergency vehicles, vehicles operated by or on behalf of a Federal, <br />Provincial or Municipal Department, a vehicle operated by a local board, <br />Board of Education, Hydro - Electric Commission, public or private utility, <br />telephone company, a commercial vehicle making a delivery to or a <br />collection from a bona fide destination which cannot be reached via <br />highway or highways upon which heavy traffic is not prohibited. <br />4. Any person(s) violating any provisions of this By -law shall be subject to <br />penalties provided in Section 125, of the Highway Traffic Act, R.S.O. <br />1990. <br />5. This By -law shall come into force and take effect on the 20th day of <br />October 2004. <br />
