L-09471 <br />LEASE EXTENSION AGREEMENT <br />THIS AGREEMENT made in triplicate as of the 1" day of March, Year Two Thousand and Four. <br />BETWEEN: 851351 Ontario Limited <br />herein called the "Landlord" <br />OF THE FIRST PART <br />THE CORPORATION OF THE COUNTY OF ESSEX <br />herein called the "Tenant" <br />OF THE SECOND PART <br />WHEREAS by a lease dated theist day of March 1992 (the "Lease "), the Landlord did lease unto <br />the Tenant for a term of 10 years commencing on March 1, 1992 and ending on February 28, <br />2002 (the "Term"), the premises more particularly described as the entire building comprising a <br />rentable area of approximately 3,670 square feet (the "Premises "), in the building municipally <br />known as 3180 Jefferson Boulevard, Windsor, Ontario (the "Building "), on the land in the City of <br />Windsor, in the County of Essex, more particularly described in Schedule "A" attached hereto (the <br />"Lands "); <br />AND WHEREAS the Lease was assigned to the Corporation of The County of Essex by the Tenant <br />on Januaryl, 2001. <br />AND WHEREAS the Lease was extended for Two (2) Years commencing on March 1, 2002 and <br />ending on February 29, 2004. <br />AND WHEREAS the parties have agreed to extend the Term of the Lease on the following terms <br />and conditions: <br />NOW THEREFORE THIS AGREEMENT WITNESSETH THAT the parties hereto agree as <br />follows: <br />1. The Term of the Lease is hereby extended for one (1) further term of (3) years commencing <br />on March 1, 2004 and ending on February 28, 2007. (the " Extension Term "), at an annual <br />rent of Seventy -Two Thousand, Four Hundred and Eighty -Two Dollars and Fifty -Two Cents <br />($72,482.52) (the "Annual Rent "), payable in advance in equal monthly instalments of Six <br />Thousand and Forty Dollars and Twenty -One Cents ($6,040.21), based on an annual rental <br />charge of Nineteen Dollars and Seventy Five Cents ($19.75) for each square foot (semi - <br />gross) of the Rentable Area of the Premises which is comprised of the aggregate of $14.50 <br />per rentable square foot for Base Rent, $3.50 per rentable square foot for Base Operating <br />Costs and $1.75 per square foot for Realty Tax. <br />The Base Year remains as per the Original Lease agreement as 1991. <br />2. The extension contemplated pursuant to this Lease Extension Agreement (this "Agreement ") <br />is subject to all the covenants and agreements contained in the Lease, as amended, renewed <br />and extended from time to time, save and except: <br />
