L-09471 LEASE EXTENSION AGREEMENT THIS AGREEMENT made in triplicate as of the 1" day of March, Year Two Thousand and Four. BETWEEN: 851351 Ontario Limited herein called the "Landlord" OF THE FIRST PART THE CORPORATION OF THE COUNTY OF ESSEX herein called the "Tenant" OF THE SECOND PART WHEREAS by a lease dated theist day of March 1992 (the "Lease "), the Landlord did lease unto the Tenant for a term of 10 years commencing on March 1, 1992 and ending on February 28, 2002 (the "Term"), the premises more particularly described as the entire building comprising a rentable area of approximately 3,670 square feet (the "Premises "), in the building municipally known as 3180 Jefferson Boulevard, Windsor, Ontario (the "Building "), on the land in the City of Windsor, in the County of Essex, more particularly described in Schedule "A" attached hereto (the "Lands "); AND WHEREAS the Lease was assigned to the Corporation of The County of Essex by the Tenant on Januaryl, 2001. AND WHEREAS the Lease was extended for Two (2) Years commencing on March 1, 2002 and ending on February 29, 2004. AND WHEREAS the parties have agreed to extend the Term of the Lease on the following terms and conditions: NOW THEREFORE THIS AGREEMENT WITNESSETH THAT the parties hereto agree as follows: 1. The Term of the Lease is hereby extended for one (1) further term of (3) years commencing on March 1, 2004 and ending on February 28, 2007. (the " Extension Term "), at an annual rent of Seventy -Two Thousand, Four Hundred and Eighty -Two Dollars and Fifty -Two Cents ($72,482.52) (the "Annual Rent "), payable in advance in equal monthly instalments of Six Thousand and Forty Dollars and Twenty -One Cents ($6,040.21), based on an annual rental charge of Nineteen Dollars and Seventy Five Cents ($19.75) for each square foot (semi - gross) of the Rentable Area of the Premises which is comprised of the aggregate of $14.50 per rentable square foot for Base Rent, $3.50 per rentable square foot for Base Operating Costs and $1.75 per square foot for Realty Tax. The Base Year remains as per the Original Lease agreement as 1991. 2. The extension contemplated pursuant to this Lease Extension Agreement (this "Agreement ") is subject to all the covenants and agreements contained in the Lease, as amended, renewed and extended from time to time, save and except:
