BETWEEN: <br /> <br />THIS AGREEMENT made in duplicate this __ <br /> <br />£! dayof /-/gtc./-/ <br /> <br />2001. <br /> <br />STERLING ACRE FARMS LIMTED, hereinafter referred to as the <br /> <br /> PARTY OF THE FIRST PART <br /> <br /> - and - <br /> <br />CORPORATION OF THE COUNTY OF ESSEX hereinafter referred to as the <br /> <br /> PARTY OF THE SECOND PART <br /> <br /> WHEREAS the Party of the First Part is the owner of certain lands lying and being in <br />the Geographic Township of Gosfield South, Town of Kingsville, in the County of Essex and Province <br />of Ontario, and being composed of part of Lot 24, Concession 5; <br /> <br /> AND WHEREAS the Party of the Second Part is the owner of certain lands situate, <br />lying and being County Rd #31, between the Municipality of Leamington and the Town of Kingsville, in the <br />County of Essex and Province of Ontario, and being adjacent to lands owned bYthe Party of the First Part; <br /> <br /> AND WHEREAS the Party of the First Part is in the business of extracting sand and <br />other aggregate materials pursuant to a licence under the Aggregate Resources Act; <br /> <br /> AND WHEREAS the property owned by the Party of the Second Part abutts lands <br />owned by the Party of the First Part; <br /> <br /> NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of <br />the premises and in consideration of the sum ofTEN ($10.00) DOLLARS now paid by the Party of the <br />First Part to the Party of the Second Part (the receipt and sufficiency whereof is hereby acknowledged) <br />the Parties hereto mutually covenant and agree as follows: <br /> <br /> <br />
