THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br />BY-LAW NUMBER 43-99 <br /> <br />A BY-LAW AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN <br />THE CORPORATION OF THE COUNTY OF ESSEX AND HER MAJESTY THE <br />QUEEN IN RIGHT OF ONTARIO AS REPRESENTED BY THE MINISTER OF <br />TRANSPORTATION FOR THE PROVINCE OF ONTARIO. <br /> <br /> WHEREAS it is deemed expedient to improve the intersection of King's Highway <br />No. 3 and County Road 48, Oak Street and Fraser Road in the Municipality of Leamington, <br />currently under the jurisdiction of the Ministry of Transportation, through the installation of <br />traffic control signals and construction of turning lanes, and <br /> <br /> WHEREAS the County of Essex is initiating the intersection improvements and will <br />be transferred jurisdiction over the intersection at some future date following completion of <br />the Leamington Bypass, and <br /> <br /> WHEREAS the traffic signal installation and turning lane construction are to be <br />undertaken at the sole responsibility and cost of the County of Essex subject to the Ministry's <br />contribution of the project design costs, and <br /> <br /> WHEREAS the Ministry of Transportation requires that prior to their issuance of <br />permits and approvals for the traffic signals and roadway reconstruction at the intersection, <br />certain terms and conditions be contained in an agreement between the Ministry and the <br />County of Essex. <br /> <br /> NOW THEREFORE BE IT ENACTED and it is hereby enacted by the Council of the <br />County of Essex as follows: <br /> <br />THAT the Agreement between the Corporation of the County of Essex and Her <br />Majesty the Queen in Right of Ontario as Represented by the Minister of <br />Transportation for the Province of Ontario for the installation of traffic control signals <br />and turning lane construction at the intersection of King's Highway No. 3 and Oak <br />Street, County Road 48 and Fraser Road attached hereto and marked Schedule "A' <br />be and the same is hereby approved. <br /> <br />THAT the Warden and the Clerk of the Corporation of the County of Essex be and <br />they are hereby authorized and empowered to execute the said Agreement tinder the <br />seal of the Corporation. <br /> <br />ENACTED AND PASSED this 20t h <br /> <br />reading <br />"d reading <br /> reading <br /> <br />October 20, 1999 <br />October 20, 1999 <br />October 20, 1999 <br /> <br /> of~, 1999. <br /> PATRICK ARDEN <br /> <br /> MARY S.
