THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br />BY-LAW # 24-99 <br /> <br />BEING A BY-LAW TO ESTABLISH A DATE ON WHICH THE <br />1998 TAX DECREASE PHASE-IN MAY BE DETERMINED AND <br />TO ESTABLISH A DATE ON OR AFTER WHICH NOTICES <br />RECALCULATING 1998 TAX LIABILITIES MAY BE ISSUED, <br />PURSUANT TO THE PROVISIONS OF THE FAIRNESS FOR <br />PROPERTY TAXPAYERS ACT, 1998. <br /> <br />WHEREAS Ontario Regulation 348/99 provides that each upper-tier and single tier <br />municipality shall determine the date on or after which notices recalculating 1998 tax <br />liabilities under section 368.0.2 of the Municipal Act, as amended, may be issued; <br /> <br />AND WHEREAS Ontario Regulation 348/99 further provides that each upper-tier and <br />single tier municipality shall determine on the said date, the percentage for 1998 under <br />paragraph 2 of subsection 447.51 (4) of the Municipal Act, as amended, for the <br />municipality; <br /> <br />NOW THEREFORE, the Council of the Corporation of the County of Essex hereby <br />enacts as follows: <br /> <br />1) THAT the date on which the 1998 tax decrease phase-in shall be calculated is hereby <br /> determined to be the 9th day of July 1999. <br /> <br />2) THAT the percentages for 1998 under paragraph 2 of subsection 447.51 (4) of the <br /> Municipal Act, as amended, for the County of Essex shall be: <br /> <br />Property Class <br /> <br />1998 Tax Decrease Phase-In <br /> <br />Multi-residential <br />Commercial <br />Industrial <br /> <br />16.6275 % <br />40.4290 % <br />55.2723 % <br /> <br />3) <br /> <br />THAT the Treasurer of each lower-tier municipality in the County of Essex shall be <br />advised by the upper-tier of the said date established in Section 1 and the 1998 tax <br />decrease phase-in percentages by class established in Section 2. <br /> <br />4) <br /> <br />THAT each lower-tier municipality advised in Section 3 shall recalculate 1998 tax <br />liabilities in accordance with Section 368.0.2 of the Municipal Act, as amended, based <br />on the frozen assessment listing for 1998 for that municipality as revised by the said <br />date determined in Section 1. <br /> <br />5) This by-law shall come into force and take effect on the date of passing. <br /> <br /> <br />
