This Agreement made this 2nd day of April, 1998 <br /> <br />BETWEEN: <br /> <br /> LEWIS MORGAN PRICE and LINDA JOAN PRICE, both of the Township <br /> of Mersea, in the County of Essex and Province of Ontario (hereinafter called "Price") <br /> <br /> Of the First Part <br /> <br />THE CORPORATION OF THE COUNTY OF ESSEX (hereinafter called <br />the "Corporation") <br /> <br />Of the Second Part <br /> <br />WHEREAS the Corporation has agreed to purchase and Price has agreed to sell a ten foot strip of <br />land situate on Lot 19,Concession 6, Township of Mersea, County of Essex being Part 1, 12R- 15979 <br />(the "Lands"); <br /> <br />AND WHEREAS as part of the consideration therefor the parties addressed certain concerns of <br />Price relating to the impact of future use of the Lands on the retained orchard; <br /> <br />THIS AGREEMENT WlTNESSETH that in consideration of the sum of One Dollar and other <br />good and valuable consideration passing between the parties, receipt of which is hereby <br />acknowledged, the parties hereto agree as follows: <br /> <br />1. For a period of five (5) years from the date of registration of conveyance of Part 1, Plan 12R- <br /> <br />15979 the Corporation agrees not to disturb the Russian Olive Hedge and the tile drainage header, <br />both of which are situate on the Lands. <br /> <br />2. If, after the expiry of the five (5) year period set out in paragraph 1, the Corporation deems <br /> <br />it necessary to remove the Russian Olive Hedge and/or the tile drain header, the Corporation shall <br />at its own expense, (1) replace the Russian Olive Hedge with a reasonably similar hedge or screen <br /> <br />pficeagreement.wpd <br /> <br /> <br />
