THE CORPORATION OF THE COUNTY OF ESSEX BY-LAW NUMBER 3289-97 A BY-LAW AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN THE CORPORATION OF THE COUNTY OF ESSEX AND HER MAJESTY THE QUEEN IN RIGHT OF ONTARIO AS REPRESENTED BY THE MINISTER OF TRANSPORTATION FOR THE PROVINCE OF ONTARIO. WHEREAS, pursuant to the Public Transportation and Highway Improvement Act, R.S.O. 1990, Chapter P. 50, Section 29(4), the Ministry of Ontario intends to transfer portions of King's Highway Nos. 3 and 18 to the Corporation of the County of Essex on January 1, 1998, and, WHEREAS, pursuant to the Municipal Act, R.S.O. 1990, Chapter M45, Section 121(2), the Corporation of the County of Essex wishes to enter into an Agreement with Her Majesty the Queen in Right of Ontario as Represented by the Ministry of Transportation for the Province of Ontario to provide Maintenance Services on the transferred portions of King's Highways from January 1, 1998 until April 12, 1998, or such other date in 1998 as the parties agree. NOW THEREFORE BE IT ENACTED and it is hereby enacted by the Council of The County of Essex as follows: THAT the Agreement between the Corporation of the County of Essex and Her Majesty the Queen in Right of Ontario as Represented by the Minister of Transportation for the Province of Ontario for the provision of maintenance services on portions of King's Highway Numbers 3 and 18 to be transferred to the County of Essex, attached hereto and marked Schedule "A' be and the same is hereby approved. THAT the Warden and Clerk of the Corporation of the County of Essex be and they are hereby authorized and empowered to execute the said Agreement under the seal of the Corporation. 3. THAT this By-law shall come into force and take effect on January 1, 1998. ENACTED AND PASSED this 19th day of November ,1997.
