County of <br />Essex <br />The Corporation of the County of Essex <br />By -Law Number 09-2015 <br />A By-law to Amend By-law 45-2006, Being a By-law to <br />Provide for Tax Refunds or Reductions in Respect of <br />Eligible Heritage Property in the Town of Kingsville. <br />Whereas by By-law 45-2006, Essex County Council established a <br />program to provide tax refunds or reductions in respect of eligible heritage <br />property in the Town of Kingsville, which was consistent with the program <br />adopted by the Council of the Town of Kingsville by By-law 20-2006; <br />And Whereas the Council of the Town of Kingsville deemed it <br />expedient to amend the tax refund or reduction program in respect of <br />eligible heritage property by adopting By-law 3-2015, in order to list the <br />maximum five year limit in connection with eligible properties within the <br />"Commercial" property tax class; <br />And Whereas the Council of the County of Essex deems it expedient <br />to amend By-law 45-2006 to reflect the amendment to the tax refund or <br />reduction program in respect of eligible heritage property, adopted in By-law <br />3-2015, by the Council of the Town of Kingsville; <br />Now therefore the Council of the Corporation of the County of Essex <br />hereby enacts as follows: <br />1. That Sections 5.1 and 5.2 of Part 5 (Classes of Property ) be amended <br />to read: <br />"5.1 One (1) heritage tax refund or reduction may be paid annually in <br />respect of each easement agreement or preservation and maintenance <br />agreement in connection with each eligible heritage property within <br />the property tax class of residential / farm / commercial as defined by <br />the Assessment Act, R.S.O. 1990, c. A 31 and Ontario Regulation <br />282/978 thereunder, as amended." <br />
