THIS AGREEMENT MADE IN TRIPLICATE THIS EIGHTEENTH DAY OF SEPTEMBER, 1997 B ]TWI ,EN THE CORPORATION OF THE COUNTY OF ESSEX hereinafter called THE COUNTY OF THE FIRST PART - AND - FIRST STEPS CHILD CARE CENTRE OF THE SECOND PART WHEREAS the day nurseries act R.S.O. 1970, hereinafter called the "ACT" authorizes the County to enter into an agreement with any person operating a licensed day nursery for the furnishing of such day nursery services for such children as is agreed upon and for making such expenditures as are necessary for that purpose. AND WHEREAS the county and the Operator have agreed that if the Operator provides day nursery services to children approved for subsidy, the County will, subject to the terms and conditions of this agreement, make certain payments to the Operator. NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the mutual covenants contained herein, the parties covenant and agree as follows: From the effective date of this agreement as set forth in paragraph 4, the Operator agrees to provide day nursery services in accordance with the Act as amended and the regulations thereto to any child which the Operator agrees to accept and in respect of which payment is made by the County under paragraph 2. For each child in respect to which it approved for the providing of day nursery services by the Operator as per the following schedule: (see Schedule · A, attached), or such other amount as may be agreed upon from time to time, between the parties hereto. The Operator shall, at his/her expense, provide and maintain by a policy or policies and in an amount satisfactory to the County the following types of insurance in connection with the day nursery services provided pursuant to this agreement. a) general liability insurance b) non-owned motor vehicle insurance c) motor vehicle insurance on vehicles owned by the operator and used in ........... ~~'~~ w~-Ttl~he ~ nUrSeq/se~ices.
