ARTICLE 1 - MANAGEMENT RIGHTS <br /> <br />1.01 <br /> <br />The Union recognizes the Corporation as a non-profit Corporation which is supporled by monies <br />raised through taxes. <br /> <br />1.02 <br /> <br />The Union acknowledges that it is the fight of the Corporation to hire, promote, demote, transfer, <br />suspend, or otherwise discipline and discharge an employee for proper cause, provided that <br />procedures contrary to this Agreement are not used and it is the fight of the Union and/or <br />employee to lodge a grievance in the manner and extent herein provided and to have it dealt with <br />in accordance with the grievance procedure hereinafter detailed. <br /> <br />The Union recognizes the fight of the Corporation to operate and manage the said Senior <br />Citizens' Home and Community Support Home in accordance with its obligations and in the <br />interest of the residents thereof, and to the community at large and to make and alter from time to <br />time rules and regulations to be obeyed by the employee, which rules and regulations shall not be <br />inconsistent with the provisions of this Agreement. Such rules and regulations and any changes <br />therein from time to time shall not be enforced by the Corporation until they have been discussed <br />with the Union and the reason for the change is explained. The change will be posted on the <br />bulletin board normally used for this purpose for a period of at least one (1) week. <br /> <br />The Corporation shall send to the Union copies of all rules, regulations and policies in force at <br />Sun Parlor Home and, from time to time as they occur, any changes or amendments thereto. <br /> <br />ARTICLE 2 - RECOGNITION AND NEGOTIATIONS <br /> <br />2.01 <br /> <br />The Corporation, or anyone authorized to act on its behalf, approves and recognizes the <br />Canadian Union of Public Employees and its Local 860 as the exclusive bargaining agent for all <br />its employees save and except Department Heads, Executive Secretary, Office Manager, persons <br />above the rank of Office Manager, Community Support Home Supervisor, Manager of Staff <br />Development, Registered Nurses and employees in Bargaining Units for which any trade Union <br />held bargaining fights as of July 1'~, 1990, and hereby consents and agrees to negotiate with the <br />Union, looking towards a peaceful and amicable settlement of any difference that may arise <br />between them. <br /> <br />2.02 <br /> <br />The parties to this Agreement agree that the Community Support Home is an entity which is <br />geographically separate from the Sun Parlor Home - Leamington and that by virtue of the <br />difference in its purpose, nature, operations and funding source, may require procedures, rules, <br />regulations and scheduling which are different from those in the Sun Parlor Home - Leamington. <br />The parties further agree that as a result of this distinct operation they will cooperate to ensure <br />that these distinct requirements are accommodated so that the Community Support Home can, at <br />all times, be operated in such a manner as to ensure the highest quality of care for the residents <br /> <br />For this reason, the Corporation and the Union have agreed to Schedule "C" of the Collective <br />Agreement between the Corporation and the Union Local 860. <br /> <br />The parties agree that at all times when interpreting an Article of the Agreement, for which there <br />is a provision in the Addendum, all subsections of that Article will be interpreted exclusively <br />according to the procedures and practices in existence at the Community Support Home. <br /> <br /> <br />
