CORPORATION OF THE COUNTY OF ESSEX BY-LAW NUMBER 3276-97 A BY-LAW TO PROVIDE FOR THE CHARGE OF EXPENSES PERTAINING TO CLOSURE AND PERPETUAL CARE AT ESSEX COUNTY LANDFILL NO. 3 DATED AUGUST 20, 1997. WHEREAS Section 209 of the Municipal Act, R.S.O. 1990 Chapter M.45, authorizes the County of Essex to pass by-laws to adopt a waste management master plan and to assume any and all of the waste management powers of the local municipalities which form part of the County of Essex; AND WHEREAS Section 209 (21) of the Municipal Act, R.S.O. 1990, Chapter M.45 provides to the Council of the County authority to pass by-laws providing for the imposition and collection from participating municipalities in which it is providing waste management services or facilities, a waste management rate to pay for the maintenance and operation of waste management services and facilities in the participating local municipalities; AND WHEREAS the Corporation of the County of Essex, on September 19, 1990, passed By-law 2847 as amended pursuant to the said provision of the Municipal Act, thereby assuming all waste management powers of the local municipalities which form part of the County of Essex; AND WHEREAS the Corporation of the County of Essex entered into an agreement with the Corporation of the City of Windsor dated February 18, 1993 which provides for the sharing of closure and post closure maintenance costs between the parties; AND WHEREAS under the agreement the City of Windsor is responsible for 91.84% of closure and post closure costs and the County of Essex is responsible for 8.16% of closure and post closure costs; AND WHEREAS the Essex County Landfill No. 3 formally closed and ceased operations on June 28, 1997; AND WHEREAS expenditures must be made in regard to closure and perpetual care of the Landfill;
