<br />THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br />BY -LAW NUMBER 45-2006 <br /> <br />A BY-LAW TO PROVIDE FOR TAX REFUNDS OR <br />REDUCTIONS IN RESPECT OF ELIGffiLE HERITAGE <br />PROPERTY IN THE TOWN OF KINGSVILLE <br /> <br />WHEREAS Section 365.2 of the Municipal Act, 2001, S. O. 2001, c.25, as <br />amended, provides that a local municipality may establish a program to provide tax <br />refunds or reductions in respect of eligible heritage property; <br /> <br />AND WHEREAS the Council of The Corporation of the Town of the Kingsville <br />adopted By-law 20-2006 on the 27fA day of February 2006 to provide for tax refunds or <br />reductions in respect of eligible heritage property; <br /> <br />AND WHEREAS Section 365.2(7) of the Municipal Act, 2001, S.O. 2001, c.25, as <br />amended, provides that an upper-tier municipality that receives a notice that a local <br />municipality has passed a by-law to provide tax refunds or reductions in respect of eligible <br />heritage property may pass a by-law to authorize a similar reduction or refund of taxes levied <br />for upper-tier purposes; <br /> <br />NOW THEREFORE the Council of The Corporation of the County of Essex <br />enacts as follows: <br /> <br />PART 1 - DEFINITIONS <br /> <br />Ll In this By-law, unless otherwise specified in this By-law: <br /> <br />(a) "assessment corporation" means the Municipal Property Assessment <br />Corporation. <br /> <br />(b) "Chief Building Official" means the Chief Building Official for The <br />Corporation of the Town of Kingsville. <br /> <br />(c) "Council" means the Council of The Corporation of the County of Essex. <br /> <br />(d) "eligible heritage property" means a property or portion of a property: <br /> <br />(i) that is located in the Town of Kingsville; <br /> <br />(ii) that is designated under Part IV of the Ontario Heritage Act, <br />R.S.O. 1990, c. 0.18, as amended, or is part of a heritage <br />conservation district under Part V of the Ontario Heritage Act; and <br />
