THE CORPORATION OF THE COUNTY OF ESSEX BY-LAW NUMBER 3238-96 A BY-LAW TO AUTHORIZE THE FILING OF A PLAN OF EXPROPRIATION AND OTHER NECESSARY ACTS FOR A LANDFILL SITE. WHEREAS The Corporation of the County of Essex, under the authority of Section 209 of the Municipal Act, R.S.O. 1990, Chapter M.45, has assumed responsibility for the establishment of a new landfill site; AND WHEREAS The Corporation of the County of Essex, in its capacity of an expropriating authority, has applied for approval to expropriate land; AND WHEREAS, upon receipt of a Report from an Inquiry Officer, The Corporation of the County of Essex, as approving authority, has approved the said expropriation. BE IT RESOLVED THAT: The Warden and the Clerk be empowered to file a Plan of Expropriation with respect to the lands described as Part 2 on Reference Plan 12R-14422, deposited in the Land Registry Office for the Registry Division of Essex (12). The Warden and the Clerk be empowered to execute such notices, offers and other documents as are required for The Corporation of the County of Essex to exercise its duties and responsibilities under the Expropriations Act and to do all other acts necessary in order to permit The Corporation of the County of Essex to expeditiously acquire possession of the said lands. The firm of Borden & Elliot, Barristers & Solicitors, is hereby appointed as solicitors authorized to undertake such acts as are necessary to assist in obtaining possession of the said lands and in resolving any claim or claims for compensation arising from the expropriation or the taking of possession or to respond to any other notice, act or claim initiated as a consequence thereof. 4. THIS By-law shall come into force and take effect on the 15th dayof May · 1996.
