BY-LAW NUMBER 3185-95 <br /> <br />BEING A BY-LAW TO PROVIDE FOR THE SEMI- <br />ANNUAL PAYMENTS OF THE AMOUNT <br />RAISED BY COUNTY MILLRATES IN 1995. <br /> <br />WHEREAS Section 374 subsection (10) of the Municipal Act provides that: <br /> <br />(10) Idem. - Despite subsection (9), the council of a county may, by <br />agreement with a majority of the lower tier municipalities in the <br />county representing at least two-thirds of the weighted assessment <br />of all the lower tier municipalities in the county, provide by by-law <br />for any number of instalments and due dates thereof other than <br />those provided in subsection (9) and those alternative instalments <br />and due dates shall be applicable to all the lower tier <br />municipalities in the county. <br /> <br />AND WHEREAS the conditions prescribed in Section 374 subsection (10) of the <br />Municipal Act have been satisfied. <br /> <br />THEREFORE the Council of the Corporation of the County of Essex enacts as <br />follows: <br /> <br />That the amount raised by County millrates and collected locally in each <br />municipality for County general and Library purposes in 1995 shall be <br />paid in two instalments. <br /> <br />That the amount that each municipality is required to collect and pay to <br />the County in 1995 for County general and Library purposes shall be paid <br />as follows: <br /> <br />(a) <br />Co) <br /> <br />50% of the amount required on June 30, 1995. <br />50% of the amount required on December 1, 1995. <br /> <br />o <br /> <br />That the provisions of this By-law shall apply only to the 1995 taxation <br />year. <br /> <br />o <br /> <br />That this by-law shall not take force or become effective except by <br />agreement with a majority of the municipalities representing at least two- <br />thirds of the equalized assessment in the County. <br /> <br />o <br /> <br />That the Warden and the Clerk be and they are hereby authorized and <br />directed to execute on behalf of the County the Agreement attached <br />hereto as Schedule "A". <br /> <br /> <br />
