THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br />BY-LAN NO. 3173-95 <br /> <br />A by-law to prohibit the taking of recyclable <br />materials within the County of Essex. <br /> <br />WHEREAS pursuant to the provisions of the Municipal Act, R.S.O. <br />1990, c. M.45, The Corporation of the County of Essex has assumed <br />waste management powers within the County of Essex; <br /> <br />AND WHEREAS The Corporation of the County of Essex has instituted <br />a program for the collection of recyclable materials within the <br />County of Essex; <br /> <br />AND WHEREAS The Corporation of the County of Essex deems it <br />necessary to take steps to prevent the removal of recyclable <br />materials by unauthorized persons; <br /> <br />NOW THEREFORE the Council of The Corporation of the County of <br />Essex enacts as follows: <br /> <br />1. DEFINITIONS <br /> <br />In this by-law: <br /> <br />(a) <br /> <br />"Corporation" shall mean The Corporation of the County <br />of Essex; <br /> <br />(b) <br /> <br />"Recyclable Material" shall mean newsprint, metal, <br />steel and aluminium food and beverage containers and <br />cans, glass containers and bottles, polyethylene <br />terephthalate (PET) containers, and any other material <br />designated by the Corporation through the multi- <br />material curbside collection program; <br /> <br />(c) <br /> <br />"Recycling receptacle" shall mean any container <br />suitable for placing recyclable material at the <br />roadside, including the "blue box" container provided <br />by the Essex-Windsor Solid Waste Authority for <br />recyclable material. <br /> <br />TITLE OF BY-LAW <br /> <br />This by-law shall be cited as "The Recycling Anti-Scavenging <br />By-Law". <br /> <br />SCOPE OF BY-LAW <br /> <br />This by-law is to apply to all local municipalities within <br />the County of Essex. Where the provisions of this by-law <br />conflict with the provisions of any other by-law of the <br />Corporation or the local municipalities of the County of <br />Essex, the provisions of this by-law shall prevail. <br /> <br />REMOVAL OF RECYCLABLE MATERIAL <br /> <br />No person shall pick over, interfere with, disturb, remove <br />or scatter any recyclable material, bundle, article or thing <br />placed out for collection, whether contained in recycling <br />receptacles, bundles or parcels or otherwise placed out for <br />collection. <br /> <br /> <br />
