BY-LAW NUMBER 3165-95 <br /> <br />A BY-LAW REQUIRING CERTAIN LOCAL MUNICIPALITIES TO <br />DISPOSE OF MUNICIPALLY COLLECTED RESIDENTIAL REFUSE <br />AT A DESIGNATED FACILITY. <br /> <br /> WHEREAS the Municipal Act, Chapter M.45, Section 209, Subsection <br />(24), R.S.O. 1990 authorizes the council of a county having assumed the <br />responsibility for providing services or facilities for the disposal treatment, <br />storage, processing, transfer, reduction, reuse, recovery or recycling of waste <br />under subsection (2) to designate one or more services or facilities for the <br />disposal, treatment, storage, processing, transfer, reduction, reuse, recovery or <br />recycling of waste or any class or classes thereof and, where such a designation <br />has been made, a participating local municipality shall not utilize any services or <br />facilities except the services or facilities that have been so designated for that local <br />municipality, <br /> <br /> NOW THEREFORE, the Council of the Corporation of the County <br />of Essex enacts as follows; <br /> <br />o <br /> <br />That the municipality of the Township of Gosfield North, the <br />Township of Gosfield South, the Town of Kingsville, the Town of <br />Leamington and the Township of Mersea are required to deliver any <br />and all municipally collected residential refuse, collected either by <br />municipal staff or by way of contract, to the Essex Windsor Solid <br />Waste Authority operated transfer station located as Part of Lot 13, <br />Concession 2, Eastern Division, Township of Gosfield South, <br />commonly referred to as Essex Windsor Transfer Station #2. <br /> <br />That this directive shall remain in force until repealed by the <br />Council of the Corporation of the County of Essex. <br /> <br />That the Warden and the Clerk be and they are hereby authorized <br />to sign this by-law under the seal of the Corporation. <br /> <br />This by-law shall come into force and take effect on the <br />10th day of April , A.D. 1995. <br /> <br /> <br />
