Settlement of Terms of Termination, dated this ( ~t day of <br /> , 1994. <br /> <br />BETWEEN: <br /> <br />Corporation of the County of Essex <br />(hereinafter called the "Corporation") <br /> <br /> Edward J. Cornies <br />(hereinafter called "Cornies") <br /> <br />WHEREAS Cornies has been an employee of the Corporation since March 5, 1979. <br /> <br />AND WHEREAS Comies has most recently occupied the position of Director, Waste <br />Management Planning and Diversion. <br /> <br />AND WHEREAS the Corporation did provide Cornies with written notice on November 8, <br />1993, that the position of Director, Waste Management Planning and Diversion would become <br />redundant on April 4, 1994, and that his employment with the Corporation would be <br />terminated as of that date. <br /> <br />AND WHEREAS Comies and the Corporation wish to settle ail outstanding issues between <br />them which arise from this termination; <br /> <br />NOW THEREFORE in consideration of the terms and provisions contained herein, and other <br />good and vaiuable consideration, the Corporation and Cornies agree as follows: <br /> <br />(i) <br /> <br />The appropriate period of notice of this termination is to be fifteen (15) <br />months from the date of written notice of termination on November 8, 1993, <br />said notice period to conclude on February 5, 1995; <br /> <br />(ii) <br /> <br />As of April 1, 1994, Comies will have been actively engaged at his work for <br />five (5) months of that notice period, thereby leaving an entitlement by <br />Comies to ten (10) further months notice after April 1, 1994; <br /> <br />(iii) <br /> <br />The Corporation shall pay to Comies his regular, non-overtime saiary, payable <br />bi-weekly at the rate being received by Cornies on April 1, 1994. Payment <br />of saiary is to continue until Cornies commences new employment or until <br />February 5, 1995, whichever shall occur first; <br /> <br />(iv) <br /> <br />If Comies obtains new employment with any employer other than the <br />Corporation, the Corporation of the City of Windsor, or the Essex-Windsor <br />Waste Management Board prior to February 5, 1995, the bi-weekly payments <br />of saiary shail cease as of the date of commencement of the new employment <br />and Comies shail be paid a lump sum payment which is equai to 50% of the <br />baiance of the salary that he would have been paid for the period from the <br />date of commencement of the new employment to February 5, 1995; <br /> <br />(v) <br /> <br />If Comies obtains employment with the Corporation, the Corporation of the <br />City of Windsor or the Essex-Windsor Waste Management Board prior to <br />February 5, 1995, the bi-weekly payment of salary shall cease as of the date <br />of commencement of the new employment and Comies shail receive no further <br />payment of saiary or other benefit from the Corporation; <br /> <br />(vi) <br /> <br />All payments to Comies shail have the appropriate statutory deductions made <br />from the gross amount as required by the various and appropriate legislation; <br /> <br /> <br />
