THIS INDENTURE, made this 16th <br /> <br />day of March <br /> <br />, 1994. <br /> <br />IN PURSUANCE OF THE SHORT FORMS OF LEASES ACT <br /> <br />B E T W E E N: <br /> <br />THE CORPORATION OF THE COUNTY OF ESSEX <br />hereinafter called the "Landlord" <br /> <br />OF THE FIRST PART <br /> <br />-and- <br /> <br />BELL CANADA <br />hereinafter called the "Tenant" <br /> <br /> OF THE SECOND PART <br /> <br />1. WITNESSETH that in consideration of the rents, covenants and <br />agreements hereinafter reserved and contained, the Landlord leases <br />to the Tenant, its successors and assigns, the property <br />(hereinafter called "the Leased Premises") in the Township of <br />Sandwich South, in the County of Essex and Province of Ontario <br />being of irregular shape approximately 80 feet wide by 140 feet, <br />and being part of Lot 20, Concession XI in the Township of Sandwich <br />South, in the County of Essex which is more particularly shown as <br />the area outlined in red on Schedule "A"Wattached hereto and <br />forming a part hereof. <br /> <br />2. TO HAVE AND TO HOLD the Leased Premises for and during the <br />term of twenty-one (21) years less one (1) day commencing on March <br />1, 1994 and fully to be complete and ended on the second last day <br />of February, 2015. Notwithstanding the foregoing, the Tenant may <br />terminate this lease at any time by giving to the Landlord six (6) <br />months prior notice of termination. <br /> <br />3. YIELDING AND PAYING therefor yearly during the term, to the <br />Landlord, its successors or assigns, the sum of One Thousand <br />Dollars ($1,000.00) to be payable in advance in one annual payment <br />on the 1st day of March in each year during the term hereof. <br /> <br />4. The Tenant shall pay all real property taxes and assessments <br />on the Leased Premises. <br /> <br />5. If the Tenant designates that taxes on the Leased Premises go <br />to support separate schools, and as a result, the taxes payable are <br />greater than if such designation had not taken place, the Tenant <br />shall pay the difference between the rate for separate and public <br />schools to the Landlord forthwith upon presentation of an account <br />in connection therewith. <br /> <br />6. In each and every year during the term, subject to the <br />foregoing, the Tenant shall pay and discharge within thirty-five <br />(35) days after same become due and payable, all business taxes, <br />rates, duties and assessments and other charges that may be levied, <br />rated, charged, or assessed against or in respect of all <br />improvements, equipment and facilities which are the direct <br />responsibility of the Tenant on or in the Premises, and every tax <br />and licence fee in respect of any and every business carried on <br />thereon or therein or in respect of the use or occupancy thereof by <br />the Tenant. <br /> <br />7. The Tenant shall contract for the supply of all services and <br />utilities necessary to the Leased Premises. <br /> <br /> <br />
