LEASE AGREEMENT <br /> <br />DATED this <br /> <br />BETWEEN: <br /> <br />day of 3anuary, 1994. <br /> <br />THE CORPORATION OF THE COUNTY OF ESSEX <br /> <br /> Hereinafter referred to as the "Landlord" <br /> <br /> - and - <br /> <br /> PLEASANT PARK FARMS INC. <br /> <br /> Hereinafter referred to as the "Tenant" <br /> <br />1. The Tenant shall have the right to continue to farm, <br />free of rent, all of the property described in Schedule A <br /> attached hereto, save and except the following, as also <br /> illustrated in Schedule A. <br /> <br />(a) <br /> <br />A strip of land extending 443.43 metres from the <br />easterly boundary of the said land where it meets the <br />Road Allowance between Concessions 3 and 4 and <br />extending 242.81 metres north from the northerly <br />boundary of the land comprising the Maidstone Landfill; <br /> <br />(b) <br /> <br />A strip of land thirty metres in width, from east to <br />west, measured from the northerly boundary of the land <br />comprising the Maidstone Landfill, such strip to extend <br />to 100 metres for a distance of 30 metres on either <br />side of the borehole nest located on the said strip of <br />land. <br /> <br />2. The Landlord will pay to the Tenant, the sum of Four <br />Thousand Nine Hundred Eighty-Six ($4,986.00) Dollars per year, <br />for the crop years 1994 and 1995 as compensation for crop loss as <br />a result of the Tenant not being able to farm eighteen (18) acres <br />of land contained within the 443.43 metres of land referred to in <br />paragraph l(a) above. <br /> <br /> The right to farm the above noted land shall be non- <br />assignable and shall end on February 29, 1996. The Tenant may <br />terminate this Lease upon giving six (6) months written notice to <br />the Landlord, such notice to be effective at the end of the crop <br />year in which notice is given. <br /> <br />4. The Landlord shall install a surface water drain in <br />this area of the property for the purposes of ensuring proper <br />drainage of the Tenant's field drainage tiles which are located <br />in the affected area. <br /> <br />Time shall, in all respects, be of the essence hereof. <br /> <br /> Upon the execution of this Lease, the Lease between the <br />parties dated March l, 1992, shall terminate. <br /> <br /> IN WITNESS WHEREOF the parties hereto have evidenced <br />their intention to be bound hereby as evidenced by the signatures <br />hereto. <br /> <br />THE CORPORATION OF THE COUNT~ <br />WARDEN ~.~ ~/~ CLERK ~------~ <br /> <br />PLEASANT PARK F RMS INC. <br /> <br /> <br />
