LEASE AGREEMENT DATED this BETWEEN: day of 3anuary, 1994. THE CORPORATION OF THE COUNTY OF ESSEX Hereinafter referred to as the "Landlord" - and - PLEASANT PARK FARMS INC. Hereinafter referred to as the "Tenant" 1. The Tenant shall have the right to continue to farm, free of rent, all of the property described in Schedule A attached hereto, save and except the following, as also illustrated in Schedule A. (a) A strip of land extending 443.43 metres from the easterly boundary of the said land where it meets the Road Allowance between Concessions 3 and 4 and extending 242.81 metres north from the northerly boundary of the land comprising the Maidstone Landfill; (b) A strip of land thirty metres in width, from east to west, measured from the northerly boundary of the land comprising the Maidstone Landfill, such strip to extend to 100 metres for a distance of 30 metres on either side of the borehole nest located on the said strip of land. 2. The Landlord will pay to the Tenant, the sum of Four Thousand Nine Hundred Eighty-Six ($4,986.00) Dollars per year, for the crop years 1994 and 1995 as compensation for crop loss as a result of the Tenant not being able to farm eighteen (18) acres of land contained within the 443.43 metres of land referred to in paragraph l(a) above. The right to farm the above noted land shall be non- assignable and shall end on February 29, 1996. The Tenant may terminate this Lease upon giving six (6) months written notice to the Landlord, such notice to be effective at the end of the crop year in which notice is given. 4. The Landlord shall install a surface water drain in this area of the property for the purposes of ensuring proper drainage of the Tenant's field drainage tiles which are located in the affected area. Time shall, in all respects, be of the essence hereof. Upon the execution of this Lease, the Lease between the parties dated March l, 1992, shall terminate.
