BY-LAW NUMBER 2928 <br /> <br />BEING a by-law to provide for payment <br />of the County rate by installments. <br /> <br />WHEREAS Section 365 subsection (14) of the Municipal Act provides <br />that: <br /> <br />Notwithstanding subsection (13), the council of the county <br />may by agreement with a majority of the municipalities <br />representing at least two-thirds of the equalized assessment <br />in the County, provide by by-law for any number of <br />installments and the amounts and due dates thereof other <br />than those provided in subsection (13). <br /> <br />NOW THEREFORE the Council of the Corporation of the County of <br />Essex enacts as follows: <br /> <br />e <br /> <br />That, the operating year January 1, 1991 to December 31, <br />1991, the amount that each municipality is required to pay <br />to the County for County purposes shall be paid as follows: <br /> <br />(a) 50 per cent of the amount required for County purposes <br /> in the current year on August 30, 1991. <br /> <br />(b) <br /> <br />50 per cent of the amount required for County purposes <br />in the current year on December 2, 1991. <br /> <br />That, in the case of non-payment of any installment or any <br />portion thereof on the due date, the municipality so in <br />default shall pay to the County interest thereon from the <br />day of default to the date that the payment is made at the <br />minimum lending rate of the majority of chartered banks on <br />the day of default. <br /> <br />That, in the event that as a result of an appeal of the <br />County's annual apportionment by-law, there is an adjustment <br />required, any such adjustment shall be made by a municipality <br />to the remaining installment or installments under Section <br />Section 2 of this by-law. <br /> <br /> <br />
