A.D., 1990. THIS AGREEMENT made in triplicate this 21st day of November BETWEEN: THE CORPORATION OF THE COUNTY OF ESSEX, AND hereinafter called the CORPORATION OF THE FIRST PART; -AND- H,G,L? Contracting Ltd, hereiuafter called the CONTRACTOR OF THE SECOND PART: WHEREAS the tender submitted by the Contractor to construct Area B Drainage Improvements including all equipment, labonrand materials at the Essex County Landfill Site #3 in the Township of Maidstone was accepted subject to the execution of this Agreement between the parties. NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideratiou of the premises and the covenants hereinafter contained, the Parties hereto agree as follows: 1. The Contractor hereby coveuants and agrees to provide and supply at his own expense, all and every kind of labour, machinery, equipment and materials required to construct Area B Drainage Improvements in accordance with the terms of this Agreement and as more specifically defined in the tender documents subzaitted by the Contractor and accepted by the Corporation all of which are attached hereto and form a part of this Agreement. 2. This Agreement shall be in full force and effective commencing the 21st day of November 1990 A.D. 3. Payment to the Contractor for the work performed pursuant to the terms of this Agreement and the said tender documents shall, be in accordance with the schedule set forth on Pages 4 thru 7 of the Form of Tender of the tender documents as attached hereto and shall be submitted to the Contractor on a monthly basis in accordance with invoiced billings submitted to the Corporation by the Contractor. The Contractor covenants and agrees to perform and comply with all terms of the general conditions to construct Area B Drainage Improvements as contained in the tender documents as attached hereto and shall form a part of this Agreement to the same extent as if they were fully embodied herein.
