~ THIS AGREEMENT made in trjplicate this day of ebruarZ . A.D. 1990. BETWEEN: THE CORPORATION OF THE COUNTY OF ESSEX, AND hereinafter called the CORPORATION OF THE FIRST PART; - AND - JARSNO EQUIPMENT INC. hereinafter called the CONTRACTOR OF THE SECOND PART; i WHEREAS the tender submitted by the Contractor to haul ',[eachate from Essex County Landfill Site No. 1 in Colchester North ownship and Landfill Site No. 2 in Gosfield South Township to the West dndsor Pollution Control Plant and the Leamington Pollution Control ~laut was accepted subject to the execution of this Agreement between the NOW THEREFORE THIS AGREEMENT WITNESSETH that in ~¢onsideration of the premises and the covenants hereinafter contained, ihe Parties hereto agree as follows The Contractor hereby covenants and agrees to provide and ;upply at his own expense, all and every kind of labour, machinery, '~quipment and materials required to haul leachate in accordance with the terms of this Agreement and as more specifically defined in the tender loc~ments submitted by the Contractor and accepted by the Corporation and the Board of Management all of which are attached hereto and form a part ~f this Agreement. ,, ommencing the __ This Agreement shall be in full force and effective 1st day of March , 1990 . Payment to the Contractor for the work performed pursuant i~o the terms of this Agreement and the said tender documents shall be in i~ccordance with the schedule set forth on Page 10 of the Form of Tender ibf the tender documents as attached hereto~nd s~all be submitted to the Contractor on a monthly basis in accordance with invoiced billings ~ubmitted to the Corporation by the Contractor. i~. The Contractor covenants and agrees to perform and comply i~ith all terms of the general conditions to haul leachate as contained in !~he tender documents as attached hereto and shall form a part of this iggreement to the same extent as if they were fully embodied herein.
