BY-LAW NUMBER 2714 <br /> <br />A BY-LAW TO REGULATE PARKING <br /> <br /> W~REAS pursuant to the provisior~ of ~he ~ur,~cipal, R.S.O. 1980, Chapter <br />302, Section 225, Paragraph 7 (c) ali Paragraph 9 the Council of the Corporation <br />of the ODunty of Essex is desirous of regulating parking; <br /> <br /> NOW THEREFORE the Gouncil of the O~rporation of the O~u~fcy of Essex <br />enacts as follows: <br /> <br />DEFiNiTiONS: <br /> <br />For the purpose of this by-law: <br /> <br />"Highway" ~cludes a cc~mon or public highway, street, avenue, uerkway, <br />driveway, square, place, bridge, viaduct or trestle, ~u~y part of which is <br />inter,ed for or used by the ge/~eral public for the passage of vehicles <br />ar~ includes the area betwee/] the lateral property lines thereof. The <br />Highly Traffic Act, R.S.O. 1980, Ona~ter 198, Section 1 (1)paragraph <br />14. <br /> <br />"Park" or "parkir~", when prohibited, means the sta~ing of a vehicle, <br />whether occupied or ~t, except wh~ sta~i~g temporarily for the purpose <br />of a~ while actually e~aged in loadir~3 or ~oading merchar~ise or <br />passer,ers. The Highway Traffic Act, R.S.O. 1980, Chapter 198, Section t <br />(1) paragraph 25. <br /> <br />"Vehicle" ir~ludes a motor vehicle, trailer, traction e~gine, f~fm <br />tractor, road-buildi~ machi~ and a~y vehicle drama4 propelled or driven <br />by any kir~ of power, including muscular power, but does ~Dt ~/]clude a <br />motorized stow vehicle, the cars or electric or steam railways ru~i~g <br />only upon rails. The Highway Traffic, R.S.O. 1980, ChaUcer 198, Section <br />1 (1) paragraph 39. <br /> <br />5~THOD OF PARKING: <br /> <br />No person shall park a vehicle on any street other th~ui a one-way street <br />unless on the right har~ side of the street having regard for the <br />direction in which the vehicle had been proceeding a~ u/~less the right <br />froht aid right rear wheels or full,ers of the vehicle are parallel to a~ <br />dista~fc respectively rDt n~re than 15 centimetres f~om the edge of the <br />roadway. <br /> <br />PARKING REGULATIONS: <br /> <br />When properly worded sigls have been erected a~ ere on display rD person <br />shall park a vehicle on the highways or part of highways hereinafter set <br />out in Schedule "A". <br /> <br />PENALTIES: <br /> <br />~y person violati~ any of the provisio~ of this by-law shall be <br />subject to a pe~k%lty of ~t more th~u~ ten dollars for the first offe~e <br />a~ rot more than fifty dollars for every subsequent offence, ~er the <br />Ontario Su~raary ODnvictio~ Act. <br /> <br /> <br />
