THis AGREEMENT DATED: July 2 , 1986 BETWEEN RED CROSS SOCIETY (WINDSOE) 1226 Ouellette Avenue WINDSOR, Ontario NSX 1J5 -and- THE CORPORATION OF T[IE COUNTY OF ESSEX Social and Family Services Department 360 Fairview Avenue West ESSEX, Ontario NSM 1Y6 (hereinafter called the AGENCY) (hereinafter called the CODNT~) WHEREAS the Agency has undertaken to supply Homemakers pursuant to the provisions of the HOmemakers and Nurses Services Act, and represents that it is an organization approved by the Minister under the said Act; NOW THEREFORE THIS INDENTURE WITNESSETH that in consideration of the premises the parties hereto MUTUALLY CONVENANT AND AGREE each with the other as follows: (1) The Agency will supply upon the terms and conditions and subject to the provisions of the said Act and the Regulations thereunder, services of a Homemaker on an hourly basis to residents of the County of Essex in the home of such resident who is elderly, handicapped, ill or convalescent, where the physician certifies that such services are necessary to enable the person to remain in his home, or to make possible his return to his own home from a hospital or other institution. (2) There shall be no obligation upon the County to pay for the said services long as and to the extent that the financial circumstances of the person applying such services shall permit him to pay for the same as determined by the Regulations. so for (3) If the financial circumstances of the person applying for such services as determined by the Regulations, do not permit him to pay in full the fees for such services, they may, with the approval of the Administrator of the Social and Family Services Department, be paid in whole or inpart by the County. Upon such approval being obtained and all provisions of the Act and the Regulations passed thereunder having been complied with to enable the County to be reimbursed by the Province of Ontario in accordance with the provision of the Act and the Regulations, the County will pay for each hour by a homemaker so provided the sum of $7.54 and the County's obligation to pay shall be limited. (4) The Agency undertakes to execute such forms and documents as may be required by the Act or the Regulations to enable the County to receive reimbursement on account of such services or as may be otherwise required by the Act or Regulations. (5) This agreement will continue until cancelled in writing with 30 days notice by either party, and Will be subject to annual review by both parties. cont/d ....
